INTRODUCTION TERMS AND CONDITIONS VILLAGO SRL

The following Terms and Conditions apply for access to the site www.villago.it and the purchase of goods and services offered by Villago srl on the site itself. The owner of the site www.villago.it is VILLAGO SRL (hereinafter Villago), with headquarters in Merone (Co), via segantini 11, VAT number 03420530135. The use of the site and the purchase of services and products through it implies unconditional acceptance of the Terms and Conditions set out below and the ineffectiveness and invalidity of any other different agreement between the site visitor and Villago. If you do not accept these Terms and Conditions, do not use the site.

Villago reserves the right to modify the Terms and Conditions for using the website at any time and without notice. These changes, revisions and/or modifications will be valid from the moment they are published on the website. Any use of the website following any changes will imply acceptance of such changes, revisions and/or modifications.

The terms and conditions provided by Villago will be indicated below, divided into 4 macro-areas:

  1. Terms and conditions for guided tours, walks, experiences and day trips (from page 2)
  2. Terms and conditions for weekends and trips;
  3. Terms and conditions for Villago V-BOXES;
  4. Terms and conditions applicable to the sale of food and wine products and beauty, culture and style products in the “shop” section of the website www.villago.it ;

The terms and conditions for stays will be specifically indicated in the appropriate “Stays” section of the website www.villago.it and will be available in the specific menu of the section itself.

Purposes and Limitations of Use

Without the express authorization of Villago it is not possible to copy, download and memorize any part of the content, or disseminate or distribute such content to third parties. Villago reserves the right to modify the services provided through the website at any time.

Various

The user accepts the application of Italian law and the exclusive jurisdiction of the Court of Como, for all disputes relating to or deriving from the use of the website and/or related services.

All rights not expressly granted here are reserved.

BY USING THE WEBSITE, THE VISITOR UNCONDITIONALLY ACCEPTS THE TERMS AND CONDITIONS.

  1. A) TERMS AND CONDITIONS FOR GUIDED TOURS, WALKS, EXPERIENCES AND DAY TRIPS

The following terms and conditions apply to the “Guided Tours”, to the “walks”, to the “experiences” and to the “trips”, better defined below, offered by the company VILLAGO SRL – tour operator, and which can be booked or purchased directly online on the website www.villago.it .

DEFINITIONS

  1. a) Guided tours: These are defined as all guided tours exclusively within public or private historical residences offered by Villago srl on the villago.it website , both in the “proposals for groups” section and in the “calendar” section, however identified by the written “guided tours”. This offer includes the possibility of visiting the historic residences chosen by Villago srl, accompanied by a guide or a Villago operator. These visits have a minimum duration of 1 hour and a maximum duration of 3 hours. They can be planned for a minimum of 2 and a maximum of 50 people.
  2. b) Walks : These are defined as all the walking itineraries in historic villages, cities, hill or mountain paths, for a minimum of 1 km and a maximum of 10 km, provided by Villago srl on the villago.it website , both in the “proposals for groups” section ” and in the “calendar” section. These walks always have as their object the historic Italian villa or residence, its possessions and its links with the surrounding area.
  3. c) Experiences : All the events or experiential initiatives carried out by Villago srl within historic public or private Italian residences and foreseen on the villago.it website are defined as such , both in the “proposals for groups” section and in the “calendar” section. . These events or experiential initiatives consist of activities where the customer is involved in carrying out re-enactment games, historical re-enactments, lunches or dinners with authorized catering, concerts and small live shows, lasting a minimum of 1 hour and a maximum of 3 hours . These experiences are carried out within the historic Italian residences selected by Villago srl.
  4. d) Excursions: “excursions” mean all the proposals of Villago srl which provide for a duration of no more than 24 hours, without overnight stay, generally consisting of two or more guided visits to historic residences and/or Italian villages or cities and a of transport.

All the activities of Villago srl described above, best summarized as PROPOSALS, can be found in the PROPOSALS FOR GROUPS section, aimed at already established groups of at least 15 people, or in the CALENDAR section, aimed at single users, couples or small groups of less than equal to 14 people, of the site www.villago.it . These PROPOSALS can also be declined in the section “Characters” and “culinary proposals” present in Proposals for groups.

  1. RESERVATIONS

All the PROPOSALS offered by Villago are limited in number, with a minimum and maximum number of participants indicated from time to time and, therefore, to participate in the “guided tours”, the “walks”, the “experiences” and the ” trips”, presented both in the “proposals for groups” section and in the “Calendar”, booking is mandatory.

1.1. Reservations follow the following methods:

1.2. Proposals in the “Calendar” section: All the proposals on the calendar can be booked online by following the specific booking form that is indicated or can be booked by email [email protected] or mobile number 3383090011. As regards the purchase, each The proposal provides for its own specific method: “payment on the spot” or “payment online”.

1.2.1. In case of booking with payment on the spot: the customer can make the booking according to the methods indicated and will receive an email confirming the booking. Subsequently, the day before the proposal is made, if the minimum number of participants is reached, they will receive the ticket to participate online at the email address left at the time of booking. For payment, the customer must pay the amount indicated to the guide or Villago operator directly on site shortly before the guided tour, walk or experience.

1.2.2. In the case of booking with online payment: If Villago provides for the “online” method for the purchase of the proposal, the customer can book and purchase the proposal directly by following the methods provided in the online form. At the time of the visit, he must indicate the receipt of payment which can be downloaded from the online system.

1.3. Proposals in the “Proposals for groups” section (on request): in this section you will find all the proposals for already established groups of at least 15 people. Users can fill out the appropriate form or contact Villago srl directly at the email [email protected] or on the cell 3383090011; a Villago operator will collect the needs of the group and propose a personalized offer.

1.4. For further and different information, users/customers can fill out the form on the site in the Contacts section of the menu, or contact Villago directly at the email [email protected] or on the cell. 3383090011.

  1. TERMS OF PAYMENT

2.1. Proposals in the “Calendar”: For on-site payments, cash; for online payment, credit card.

2.1.1. For all online payments we use the STRIPE payment circuit because it is the world leader in online payments and is a guarantee of security for Villago and for its users/customers.

2.2. Proposals in “proposals for groups” (on request): by bank transfer (unless otherwise expressly agreed upon, especially in the case of proximity to the date of the event/guided tour).

2.3. Billing and exemptions:

2.3.1. The Customer is required to provide all the fiscal data required by law in advance at the time of booking and to expressly request the issue of the invoice already at the time of the estimate.

2.3.2. The guided tour services (which also include walks and some experiences that can be declined as guided tours), pursuant to art. 10, no. 22 Presidential Decree n. 633/1972 are exempt from VAT;

2.3.3. Villago srl, for the Proposals referred to in point 2.3.2, is exempt from issuing a tax receipt pursuant to art. 2 lett. n) Dpr n. 696/1996.

2.3.4. Villago srl is not required to issue an invoice unless the customer requests it expressly and in advance pursuant to art. 22, no. 6 Presidential Decree n. 633/72.

  1. THE PRICE INCLUDES / DOES NOT INCLUDE

All our offers include:

3.1. the cultural activity service carried out by authorized tourist guides, authorized Villago cultural operators in private places, or by the owners of the historic residences themselves.

3.2. Third party liability insurance coverage with a leading insurance company to protect all visitors from involuntary damage caused by our staff during the guided tour.

3.3. The visits in the Calendar also include:

3.3.1. the price of the entrance ticket to the historic public or private residences to be visited;

3.3.2. The price of the entrance ticket to museums and exhibitions, if any;

3.4. Requests for changes or extensions of the hours of guided tours and events are not accepted, unless expressly agreed upon and subject to availability verification.

3.5. All our offers do not include, except in cases expressly indicated, any additional extras (for example catering, tips, offers to places of worship, etc.)

  1. DISABLED / OTHER REDUCTIONS

4.1. We apply a 50% reduction on the cultural activity service of the Proposals in the Calendar for both the disabled person and one of their companions, upon presentation at the entrance of the historic residence or at the beginning of the walk of a nominal document certifying the disability. Failing that, Villago srl will apply the full price of the ticket or, if the payment was made online, will request the integration of the price.

4.1.1. Beneficiaries (up to a maximum of two per guided tour where places are still available):

– blind, deaf and severe motor disabilities;

– psychic and mentally disabled

4.2. Villago also offers special discounts for children and families:

4.2.1. Children from 0 to 6 years old included (the following provisions apply up to a maximum of two per guided tour where places are still available):

– for all the proposals in the Calendar, the cultural activity service is free (except for any entrance tickets according to the conditions set by the museum or other body);

– for all the other proposals in the Calendar which provide for the use of means of transport, it is necessary to request information from Villago srl, which reserves the right to evaluate the applicable discounts from time to time.

4.2.2. Children aged 7 to 14 included (the following provisions apply up to a maximum of two per guided tour where places are still available):

– 50% reduction for the proposals in the Calendar, unless otherwise provided by the historic residence or the institution to be visited

4.3.In the event of problems with online booking, if requested, the user/customer is asked to fill in the form on the site in the Contacts section of the menu, specifying their needs, the chosen proposal and the date. Villago srl will provide all the most useful information and instructions for proceeding with the online booking.

4.4. Any rights to discounts (coupon codes) and/or reductions on entrance tickets must be entered and/or selected at the time of purchase, under penalty of forfeiture of this right.

  1. LANGUAGES

5.1. All services related to the Proposals are provided in Italian unless expressly established in the request or booking.

5.1.1. All the proposals requested for groups can be provided in different languages ​​- even non-European ones – subject to availability verification and the possible addition of an additional cost.

  1. TRANSPORT

6.1. For trips, Villago organizes from time to time the coach that it deems most suitable for the booked group, without having to notify users / customers, before the trip, of the type and model chosen. Seats on the bus are assigned on the basis of the reservation and communicated by the escort on the day of departure and remain fixed for the entire journey.

6.2 For special needs, users/customers at the time of booking must inform Villago of the problem and, if possible, the latter reserves the right to evaluate the possibility of assigning the requested seats.

  1. RESTAURANT

7.1. The meals offered during the trips or experiences are set menus. Any request to change one or more courses, made during the trip, must be paid directly to the restaurateur or caterer in charge on the basis of the published “à la carte” prices (where available). It is important to note that the menus abroad may be different from those to which the Italian customer is accustomed, since in most cases the customs of the local gastronomy are followed.

7.2 There is no refund for meals not taken for personal reasons.

  1. FOOD ALLERGY

8.1. Changes to the menus are always subject to the availability of the restaurateurs or the catering service. Serious dietary problems such as allergies to particular types of food must be reported at the time of booking. The report will be forwarded to restaurateurs, hoteliers or any catering, but this will not constitute a guarantee towards allergic people who will in any case be required to sign a release which will relieve Villago srl of any liability.

8.2. If the restaurateurs have prepared dishes suitable to satisfy the reports received, it will not be possible to replace these dishes except with orders from the “à la carte” menu (where available and for a fee).

  1. HOW TO PREPARE FOR GUIDED TOURS, WALKS, EXPERIENCES and TRIPS (proposals)

9.1. The details: date, time, meeting place and any further useful information are indicated in the following ways depending on the type of proposal:

9.1.1. Proposals in the Calendar: in the description of the proposal in the calendar e-mail and in the confirmation email, to be considered complementary and not a substitute for the description in the calendar (except for any changes that we will promptly communicate);

9.1.2. Proposals for groups (upon request): in the description relating to the proposal directly on the site and in the e-mail that Villago srl will send to the Customer a few days before the date of the event/guided tour, including the necessary attachments where applicable.

9.2. Except for special experiences in historic residences where there is a particular dress code, which will be specified online, we always recommend comfortable shoes and clothing suitable for the expected weather.

9.3. In the case of a visit that includes a place of worship, appropriate clothing is required (for women shoulders and preferably knees covered, for men at least a t-shirt and a pair of shorts). Villago does not consider itself responsible in case of prohibition of access or expulsion from the place of worship due to inappropriate clothing by users/customers.

  1. BAD WEATHER

10.1. Our PROPOSALS are confirmed even in case of bad weather, except for adverse conditions which make the execution of the proposal difficult. In this case Villago srl will inform the participants of the cancellation. In the case of additional third-party services (tram cars, boats, etc.) you are still subject to the regulations imposed by the supplier.

10.2. In case of cancellation by Villago srl, we refer to the following points.

  1. CHANGES or CANCELLATIONS

11.1. Variation of dates, stages and times: they may undergo variations or limitations due to operational needs or force majeure (strikes, partial or total extraordinary closure of the historic residences or of the various visitor venues, breakdowns of the surface or navigation means used during the visit, natural disasters, demonstrations, changes to the road system, disorganization of the visiting institutions, etc.) not attributable to Villago srl.

11.2. With regard to any requests for changes or extensions of hours, please refer to the previous points.

11.3. Rate changes: in the event of unexpected cost increases or regulatory changes, the rates will be updated and communicated via e-mail to the Customer for the adjustment.

11.4. Cancellations by Villago srl: if the variations or limitations concern an essential part of the visit or event, Villago srl will proceed with the cancellation by communicating by telephone and/or via e-mail and will propose, where possible, a change in the date of the booked proposal or purchased. The Customer will then be able to accept the transfer of the proposal to the new date indicated or, if he has already paid, request a refund of the amount paid (always without prejudice to the costs of entrance tickets to museums and exhibitions, if any, as well as the additional costs associated with the refund) .

11.5. Any complaints – under penalty of forfeiture – must be sent, without delay and in any case no later than 10 days from the date of the guided tour, walk or experience, to the email address [email protected]

  1. CUSTOMER CANCELLATION

12.1. Cancellations must be sent to the e-mail address [email protected] and, only if the user/customer has already paid, will they give rise to the following refunds (always without prejudice to the cost of entrance tickets to museums and exhibitions, if any, as well as the additional costs associated with the refund), according to the date of receipt of the cancellation (the date of the email received from Villago will prevail) and the type of service booked:

12.2. Proposals in Calendar paid online:

12.2.1. Up to the 5th day before the date scheduled for making the proposal, 100% of the amount paid will be refunded

12.2.2. From the 4th to the 2nd day before the date scheduled for making the proposal, the amount equal to 70% of the amount paid will be refunded;

12.2.3. From the day before the date scheduled for making the proposal, the reservation is considered definitively confirmed, can no longer be canceled and therefore no longer refundable.

12.2.4. In case of no-show at the meeting place at the scheduled time (no-show), or in case of loss of contact with the guide once the visit has begun, the booking is considered definitively confirmed and therefore no refund is recognized.

12.3. Proposals for groups (upon request) (unless otherwise agreed expressly):

12.3.1. Up to the 7th day prior to the date envisaged for making the proposal, 100% of the amount paid will be refunded or, if the cost of the proposal has not yet been paid, nothing will have to be paid;

12.3.2. From the 6th day to the 3rd day before the date scheduled for making the proposal, 50% of the amount paid will be refunded or, if the cost of the proposal has not yet been paid, 50% of the total must be paid to Villago;

12.3.3. From the 2nd day prior to the date scheduled for making the proposal, the reservation is considered definitively confirmed, can no longer be canceled and therefore no longer refundable. If the cost of the proposal has not yet been paid, the group will have to pay the full cost;

12.3.5. In case of no-show at the meeting place at the scheduled time (no-show), or in case of loss of contact with the guide once the visit has begun, the booking is considered definitively confirmed and therefore no refund is recognized. If the cost of the proposal has not yet been paid, the group will have to pay the full cost;

  1. COPYRIGHT

13.1. All catalogues, images, videos and texts – inserted on the website or sent via any different medium – constitute the creation of intellectual property of Villago srl and (unless expressly indicated) all inherent rights are reserved. The reproduction and diffusion, even partial, in any form, of the photographs, images, videos and texts is prohibited. Any links will only be permitted through the sharing channels on the site or with the prior written authorization of Villago srl.

13.2. The trademarks and distinctive signs of Villago srl are the exclusive property of the same.

13.3. Violators will be prosecuted according to the law.

  1. CONFIDENTIALITY

14.1. Personal data is processed pursuant to the GDPR 2016/679 and its subsequent amendments and additions.

14.2. The data controller, for the purposes indicated below, is Villago srl with registered office in Merone (CO) (22046), via Segantini 11.

  1. JURISDICTION

15.1. For any dispute, the Court of Como is exclusively competent.

  1. B) TERMS AND CONDITIONS FOR WEEKENDS AND TRAVELS

The following general conditions apply to tours, stays, travel and any tourist package offered by VILLAGO SRL, which can be booked and/or purchased directly on the website www.villago.it

GENERAL CONDITIONS OF CONTRACT FOR THE SALE OF TOURIST PACKAGES AND ORGANIZED TRAVEL

  1. PREMISE. THE TOURIST PACKAGE

Given that:

  1. a) the organizer and the seller of the tourist package, to whom the consumer applies, must be in possession of the administrative authorization to carry out their activities;
  2. b) the consumer has the right to receive a copy of the tourist package sales contract (pursuant to article 85 of the Consumer Code), which is an indispensable document for accessing the Guarantee Fund pursuant to art. 18 of these General Terms and Conditions.
  • Tourist packages (art. 84 of the Consumer Code): The tourist packages concern travel, holidays and “all inclusive” circuits, resulting from the pre-established combination of at least two of the following elements, sold or offered for sale to a flat-rate oted, and with a duration otedr of 24 hours or extending for an oted of time including at least one ote:
  1. a) transportation;
  2. b) accommodation;
  3. c) tourist services not ancillary to transport or accommodation (omissis)… which constitute a significant part of the “tourist package”.
  4. LEGISLATIVE SOURCES:

The sale and purchase of a tourist package, whether it concerns services to be provided in Italy or abroad, will be governed by Law 12/27/1977 No. 1084 ratifying and implementing the International Convention relating to the travel contract (CCV) signed in Brussels on 23.4.1970 as applicable as well as by the Consumer Code. The tourist package purchase and sale contract is governed not only by these general conditions, but also by the clauses indicated in the travel documentation delivered to the consumer and by the general information indicated in the “General Information” paragraph.

  1. MANDATORY INFORMATION – TECHNICAL SHEET:

The organizer has the obligation to create a technical sheet in the catalog or in the non-catalogued programme. The mandatory elements to be included in the technical data sheet of the catalog or non-catalog program are:

– details of the organiser’s administrative authorisation;

– details of the civil liability insurance policy;

– period of validity of the catalog or non-catalogue program or tailor-made trip;

– methods and conditions of replacement (Article 89 of the Consumer Code);

– reference exchange for the purpose of currency adjustments, day or value.

  1. RESERVATIONS

4.1. The booking request must be drawn up on a specific contractual form, electronic if necessary, completed in all its parts and signed by the customer, who will receive a copy. The acceptance of reservations by Villago srl is subject to the availability of seats and is understood to be perfected, with the consequent conclusion of the contract, only when Villago srl sends the relative confirmation, also by electronic means, to the customer.

4.2 The information relating to the tourist package not contained in the contractual documents, in the brochures or in other means of written communication, will be provided by the organizer in regular fulfillment of the obligations established for him by art. 87 paragraph 2 of the Consumer Code before the start of the trip.

  1. PAYMENTS

3.1. At the time of booking, a deposit equal to 25% of the participation fee must be paid and, if required, the entire registration fee must be paid. The balance must be paid 15 days before the departure of the trip. For registrations made in the 15 days prior to departure, the full amount must be paid at the time of booking. Failure to comply with these conditions by the participant registered for the trip authorizes Villago srl to cancel the reservations even if they have already been confirmed.

3.2 Registration implies, on the part of the traveller, full acceptance of these rules and conditions.

  1. PROGRAM CHANGES

Villago srl, before departure, has the right to significantly modify the travel program as provided for in art. 91 of Legislative Decree 206 of 06/09/2005. After departure, where an essential part of the services provided for in the contract cannot be performed, the organizer will arrange suitable alternative solutions for the continuation of the journey.

  1. CANCELLATION OF THE TRIP BY THE ORGANIZER VILLAGO SRL

5.1. Villago srl reserves the right not to carry out the trip if the minimum number of participants foreseen and indicated for each trip is not reached, informing the traveler at least 10 days before the scheduled departure date. The organizer pursuant to art. 91 of Legislative Decree 206 of 09/06/2005 can also cancel the travel contract, totally or partially, without any compensation, due to circumstances of an exceptional nature or unforeseeable events at any time before departure upon immediate communication.

5.2. For any other case of non-execution of the trip by the organizer, the provisions of the laws and decrees previously indicated will prevail.

  1. COMPLAINTS

6.1. Any failure in the execution of the contract must be contested without delay so that the organizer, his local representative or the accompanying person can promptly remedy it. The traveler can also file a complaint by sending a registered letter with return receipt to the organizer or seller within and no later than 10 working days from the return date of the trip. However, the organizer will be exempt from any responsibility, for events that were disputed only upon return and which could have been remedied if highlighted to the operators during the trip.

  1. SPECIAL NEEDS OF THE TRAVELER

7.1. The traveler is required to present his special needs in writing at the time of booking. VILLAGO SRL reserves the right to accept these particular requests, after having checked the availability of the suppliers who will have to provide the services.

7.2. VILLAGO SRL will send the traveler a communication relating to any additional costs deriving from these requests as soon as possible, provided that they are feasible.

  1. ASSIGNMENT / WITHDRAWAL

8.1. TRANSFER OF THE RESERVATION

The traveller, who is unable to take advantage of the booked trip, can transfer his reservation to a person who satisfies all the conditions required for the trip after informing VILLAGO SRL by e-mail or registered letter with return receipt, in urgent cases by telegram , which must be received no later than 4 working days before departure, indicating the personal details of the transferee. The transferor traveler and the transferee are jointly responsible for the payment of the balance of the price and any additional expenses deriving from the transfer. The cancellation of the trip by a participant with accommodation in a double room involves the payment of the single supplement.

8.2 WITHDRAWAL

If a participant registered for the trip should withdraw from the contract for cases other than those provided for in articles 90 and 91 of Legislative Decree 206 of 09/06/2005, he will be entitled to a refund of the participation fee net of the penalties indicated below, in addition to the and expenses to be incurred for the cancellation of the services, – 10%, of the participation fee up to 30 days before the departure of the trip – 25%, of the participation fee up to 21 days before the departure of the trip – 50%, of the participation fee up to 11 days before the departure of the trip – 75%, of the participation fee up to 3 days before the departure of the trip NO REFUND AFTER THIS TERM. No refund will be granted to those who do not show up for departure or who give up during the course of the trip.

9. WITHDRAWAL WITHOUT PENALTY

The traveler can withdraw from the travel contract without any penalty in the event of a significant modification of one of the essential elements of the contract such as: an increase in the price of the all-inclusive trip of more than 10% of the global price (as described in the following point); postponement of the departure date by more than two working days; change in the category of the hotel or in the quality of the accommodation facility. In this case, the traveler will be required to communicate, within 2 working days of receiving the modification communication, whether he intends to exercise the right of withdrawal, or accept the modification.

  1. VALIDITY OF PARTICIPATION FEE

The quotas are calculated on the basis of the exchange rates, the carriers’ tariffs and the costs of the services indicated in the travel program at the time of its issue. Therefore, the quotas may be changed as a result of changes in the cost of transport, fuel, duties and taxes such as landing, disembarkation or embarkation in ports or airports, accommodation and VAT, the exchange rate applied. The revision of the price cannot in any case be implemented in the 20 days preceding the scheduled departure date. If the global increase exceeds the participation fee by 10%, the participant has the right to withdraw from the contract as long as he gives written notice to the organizer within 2 working days of receiving the communication relating to the increase.

  1. GUARANTEE FUND INSURANCE

Villago srl is covered by the EUROP ASSISTANCE INSURANCE POLICY N°8551336 for civil liability pursuant to art. 99 of Legislative Decree 206 of 06/09/2005. Pursuant to art. 100 of the aforementioned Decree, a Guarantee Fund has been set up at the Ministry of Productive Activities which all travelers can use, in the event of insolvency or bankruptcy of the organizer, for the reimbursement of the price paid and repatriation in the event of trips to abroad.

  1. EXCHANGES USED AND VALIDITY OF THE PROGRAM

Prices are expressed in euros. For countries not belonging to the European monetary union, the quotas have been calculated on the basis of the official exchange rates of the European Central Bank on 08/10/2013. Program validity: from 11/16/2013 to 12/31/2014 free advertising print. This contract is regulated by the Italian law. Program created in compliance with art. 12 of the regional law of 30 March 1988.

  1. HOTEL ACCOMMODATION and ACCOMMODATION FACILITIES

13.2. Villago also offers accommodation solutions in quality historic Italian residences, indicating the specifications of the accommodation, features and services in the travel contract.

  1. RESTAURANT

14.1. The meals offered during our trips are set menus. Any request to change one or more courses, made during the trip, must be paid directly to the restaurateur based on the published “à la carte” prices (where available). It is important to note that the menus abroad may be different from those to which the Italian customer is accustomed, since in most cases the customs of the local gastronomy are followed. There is no refund for meals not taken for personal reasons.

14.2. FOOD ALLERGY. Changes to the menus are always subject to the availability of the restaurateurs. Serious dietary problems such as allergies to particular types of food must be reported at the time of booking. The report will be forwarded to restaurateurs and hoteliers, but this will not constitute a guarantee towards allergic people who will in any case be required to sign a release which will relieve Villago srl of any liability. If the restaurateurs have prepared dishes suitable to satisfy the reports received, it will not be possible to replace these dishes except with orders from the “à la carte” menu (where available and for a fee).

  1. DOCUMENTS FOR EXPATRIATION

For adult Italian citizens, a valid identity card is required for expatriation for all countries belonging to the European Union. ATTENTION: an identity card with an extension of the expiry date from 5 to 10 years is not considered a valid document for expatriation. IMPORTANT: the driving license is not a valid document for expatriation. For minors, it is always essential to check with the Police Headquarters or the area Commissariat which documents are required for expatriation, regardless of the country visited. The minor must have an identity card valid for expatriation for all countries belonging to the European Union, as well as a certificate of maternity and paternity, if accompanied by one or both parents, or a proxy for accompaniment issued and endorsed by the Police Headquarters. Travelers of non-Italian citizenship must contact their Consulate or Embassy to receive information on the documents and/or visas required to enter the countries they wish to visit. It should be noted that for foreign citizens residing in Italy, possession of a residence permit and/or Italian identity card cannot be considered sufficient for expatriation. ATTENTION: the information in this section is to be considered valid on the date of publication of this catalogue. Each traveler is therefore invited to inquire with the competent authorities (Police Headquarters, Consulates or Embassies) regarding the compliance of the aforementioned indications with the laws and regulations in force at the time of departure. Villago srl is not responsible for the validity of individual documents. IMPORTANT:

16.1. The vehicles used by Villago srl for trips lasting more than one day are equipped with ARMCHAIRS and the main comforts: air conditioning, mini-bar (soft drinks for a fee), espresso coffee machine (for a fee), CD/DVD player. All buses have a toilet on board for any emergencies.

16.2. The seats on the bus are assigned on the basis of the reservation with payment of the deposit and communicated by the escort on the day of departure and remain fixed for the entire journey. Villago srl reserves the right to make changes to the assigned seats, even of single units of the groups, based on the filling needs of the buses, or in cases of particular needs and/or problems of the travellers. We also specify that the movements will be a maximum of one row.

16.3. All buses (excluding 1-day trips) are equipped with a sofa bed, it should be noted that due to the conformation and structure of the vehicles, not all seats have the same spaces, those on the tables and in the front row of double-decker buses are not equipped of the “leg raiser” mechanism

  1. CHILDREN

Since the same regulations apply on the bus as on the car, parents must bring a child seat which must be fixed to the seat with the appropriate seat belt.

  1. CLOTHING

We recommend comfortable clothing suitable for the current season (small backpack, keeway, umbrella), walking boots with non-slip soles are recommended. We take the liberty of recommending that everyone base their clothing on the spirit of the journey and of the places indicated in the programme.

  1. TELEPHONE

For calls made from abroad, always dial the prefix 0039 followed by the prefix for your area including 0 (e.g. Como: 0039 031…….) and the desired number (ask your operator about the rates), you can use the service all inside the hotel. Upon departure, you will be given a name tag bearing the escort’s emergency telephone number, open 24 hours a day, which you are requested to call in case of need ONLY during the trip.

  1. INSURANCE PROVIDED IN THE TOURIST PACKAGE

ALL OUR TOURIST PACKAGES PROVIDE INCLUDED IN THE PRICE TRAVELERS INSURANCE COVERAGE WITH EUROP ASSISTANCE UNDER THE FOLLOWING CONDITIONS:

Art. 1 – Object of the insurance

  1. A) ASSISTANCE WARRANTY

TRAVEL ASSISTANCE

You can request the following benefits from Europ Assistance in the event of an accident, illness or in the event of Covid-19 which must directly affect you, a family member or a travel companion, provided that you are insured and traveling with you. The causes indicated must occur during the trip .

  • MEDICAL ADVICE

If you are ill and/or injured while travelling, you can ask for a medical opinion by telephone. Doctors use the information you give them to evaluate your state of health. This opinion is not a diagnosis. You can request this service 24/7.

  • SENDING A DOCTOR OR AN AMBULANCE TO ITALY

You can request this service only if you are traveling and after having had a MEDICAL CONSULTATION. If you are in Italy and need a medical check-up or an ambulance, the Organizational Structure sends a chosen and approved doctor to the place where you are during the trip. When no doctor can intervene personally, the Organizational Structure transports you by ambulance to the nearest specialized medical centre. This is not an emergency service, in this case call 118.

The timetable for providing services is as follows:

  • from Monday to Friday, from 20 to 8,
  • on Saturdays, Sundays and public holidays, 24 hours a day.
  • REPORTING A SPECIALIST ABROAD

You can request this service only if you are traveling and after having had a MEDICAL CONSULTATION. If you are abroad and want to know which is the closest doctor for a specialist visit, the Organizational Structure will indicate the doctor’s name, compatibly with local availability.

  • SANITARY RETURN

You can request medical return when, after an accident and/or sudden illness, the doctors of the Organizational Structure together with the doctors on site decide that you can be transferred

– in an equipped care institute in the place where you are, or

– in an equipped health institute in the place where you have your residence, or

– at your residence.

The definitive decision is in any case the one taken by the doctors of the Organizational Structure. Europ Assistance organizes and pays for your medical return within the times and with the means most suited to the situation.

The means of transport are:

– medical plane; which is used, when available, only and exclusively if you reside in Italy and when the accident occurs in one of the European countries or in the countries of the Mediterranean Basin.

– airliner in economy class, even with space for a stretcher if you have to lie down;

– first class train and, if necessary, with sleeping car;

– ambulance.

The Organizational Structure also provides medical or nursing assistance during the return journey if its doctors deem it necessary.

You can request a transfer to the nearest place equipped for the Emergency Department or a medical institution, or a transfer to a medical institution suitable for the treatment of your illness, when you are hospitalized in a local structure that is not suitable for the treatment of your pathology , the Organizational Structure will organize the transfer, with the means and in the times deemed most suitable by the doctors of the Organizational Structure after consulting them with the attending physician on site.

In this case, Europ Assistance pays the costs on your behalf up to a maximum of Euro 7,500.00.

Europ Assistance may ask you for a return ticket that you do not use.

In the event of death, the Organizational Structure will organize the transport of the body to the burial place in the country of residence or to the nearest international airport. The definitive decision is in any case the one taken by the Organizational Structure. Europ Assistance only pays the cost of transporting the deceased.

  • RETURN WITH AN INSURED FAMILY MEMBER

When during the organization of the “Return to Health” service, the doctors of the Organizational Structure do not deem medical assistance to the Insured Party necessary during the trip, and one of your insured family members wishes to accompany you to the place of hospitalization or to your residence, the The Organizational Structure will also arrange for the family member to return using the same means used for you. Europ Assistance may request any unused travel ticket for the return of the family member.

  • RETURN OF OTHER INSURED

You can request the Return of the other Insured Persons only after the “RETURN TO HEALTH”

If the other insured persons traveling with you are objectively unable to return home with the means of transport envisaged and/or used at the beginning of the trip, the Organizational Structure books a ticket for them to return to their residence.

Europ Assistance pays the costs for a first class train ticket or an economy class plane ticket on your behalf, up to a maximum amount of Euro 200.00 per insured person. Europ Assistance can ask you for the return ticket that the other insured they don’t use.

  • TRIP OF A FAMILY

You can request that a family member join you if, during the trip, you are hospitalized in a medical institution for more than 7 days and you need their help.

The Organizational Structure books a ticket to join you, for your family member residing in Italy so that they can stay with you.

Europ Assistance pays the costs for a first class train ticket or an economy class plane ticket on your behalf.

  • ACCOMPANIMENT OF MINORS

You can request the accompaniment of minors under the age of 15 traveling with you if you have an accident or illness or when, due to a reason beyond your control, you are unable to take care of them.

The Organizational Structure books a return ticket for a family member. This return ticket is used to reach the minors and bring them back to their residence.

Europ Assistance pays the costs for a first class train ticket or an economy class plane ticket on your behalf.

  • RETURN OF THE CONVALESCENT INSURED

You can request to return to your residence if you are convalescing after an illness or injury and cannot use the means initially envisaged for returning from the trip.

The Organizational Structure books a ticket for you, for one of your family members or travel companions, provided they are insured.

Europ Assistance pays the cost of a first-class train ticket or an economy-class plane ticket on your behalf.

Europ Assistance may ask you for the return ticket that you have not used.

  • EXTENSION OF STAY

You can request to extend your stay, if a medical certificate confirms that illness or injury prevents you from returning home on the date you had planned. In this case, the Organizational Structure books a hotel for you, for one of your family members or a travel companion, provided that you are insured.

Europ Assistance only pays the expenses for the room and breakfast for a maximum of 3 days following the date established for your return and up to a maximum total amount of Euro 40.00 per day for each insured person.

  • INFORMATION AND REPORTING OF CORRESPONDING MEDICINAL PRODUCTS ABROAD

(the service is valid only for residents in Italy)

You can request information on medicines when you are abroad, have an illness and/or have been injured, and need to receive information on medicinal products duly registered in Italy; in this case the Organizational Structure will notify you of the corresponding medicines, if any, available locally.

  • INTERPRETER AVAILABLE ABROAD

You can request an interpreter if you are hospitalized in a healthcare institution abroad and you have difficulty communicating with the doctors because you do not know the local language.

The Organizational Structure sends you an interpreter to the hospital for daily interviews with the doctors of the Healthcare Institute.

Europ Assistance pays the cost of the interpreter for a maximum of 8 working hours

  • ADVANCE OF FIRST NECESSARY EXPENSES

(the service is valid only for residents in Italy)

You can have an advance for essential expenses if you have had:

– an injury

– a disease,

– theft, robbery, mugging or non-delivery of baggage and you have unforeseen expenses that you cannot pay.

The Organizational Structure advances invoices for you, on the spot, up to a maximum amount of Euro 5,000.00.

Europ Assistance, when the total invoices exceed 150.00 euros, may decide to advance you even a greater amount of money if you can provide an economic guarantee.

The Organizational Structure guarantees you an advance on basic necessities if:

– the money transfer respects the rules or regulations in Italy or in the country where you are

– you demonstrate that you are able to return the amount of money

– Europ Assistance Branches or Correspondents exist in the country where you are to be able to make the Advance.

Caution:

Within one month from the date of the advance, you will have to repay the advance amount.

If you don’t, you’ll pay interest at the current legal rate.

  • EARLY RETURN

You, your family members and an insured Travel Companion traveling with you may be forced to return home earlier than expected due to the death or imminently life-threatening hospitalization of one of the following family members: spouse/partner more uxorio, son/daughter, brother, sister, parent, father-in-law, son-in-law, daughter-in-law.

The date of death must appear on the death certificate issued by the registry office. Europ Assistance pays for a first class train ticket or an economy class air ticket for you to allow you to reach the place where the burial will take place or where your family member is hospitalised.

If you are traveling with a minor, the Organizational Structure will allow you both to return provided that the minor is also insured.

If you are traveling with a vehicle and cannot use it to return early, the Organizational Structure will also provide you with a ticket so that you can later go and retrieve it.

Within 15 days of the event that forced you to return early, you must send Europ Assistance the death certificate or the documents demonstrating the hospitalization of the family member and that his or her life is in danger.

  • RETURN TO THE RESIDENCE FOLLOWING COVID-19

If you are unable to return to your residence with the means you had booked at the beginning of the trip, call the Organizational Structure.

The Organizational Structure books for you, for one of your family members or travel companions, provided they are insured, the ticket office necessary for your return home.

As far as airline tickets are concerned, economy class will always be recognized.

Europ Assistance pays the costs for the ticket per Insured Person and for the duration of the Policy on your behalf. Up to the ceiling of Euro 1,000.00.

Europ Assistance may ask you to return the tickets that you were unable to use to return home.

  • ADVANCE OF CRIMINAL SECURITY ABROAD

(the service is valid only for residents in Italy)

You can request an advance on bail if you have been arrested abroad or are threatened with being arrested and you have to pay bail to be released.

The Organizational Structure advances the penal bail on your behalf, directly on the spot, up to a maximum total amount of Euro 15,000.00.

In no case will Europ Assistance pay a sum exceeding 15,000.00 Euros.

The service will be operational when you can provide an economic guarantee.

The Organizational Structure guarantees you the Advance Penalty Deposit if:

– the money transfer respects the rules or regulations in Italy or in the country where you are

– you demonstrate that you are able to return the amount of money

– Europ Assistance Branches or Correspondents exist in the country where you are to be able to make the Advance.

Caution:

Within one month from the date of the advance, you will have to repay the advance amount. If you don’t, you’ll pay interest at the current legal rate.

  • LEGAL NOTICE ABROAD

You can ask for a lawyer’s report if you are abroad and are arrested or risk being arrested.

The Organizational Structure notifies you of the lawyer based on local rules and availability. This occurs in countries where there are branches or correspondents of Europ Assistance.

This is just a report and the legal costs remain at your expense.

  • SEND URGENT MESSAGES

You can ask for messages to be sent when, due to illness and/or injury, you are unable to send urgent messages to people residing in Italy, the Organizational Structure will ensure that the message is communicated to the recipient.

The Organizational Structure is not responsible for the messages transmitted.

VEHICLE ASSISTANCE

  • ROADSIDE ASSISTANCE

If during the trip, the vehicle you are traveling with stops due to a breakdown and/or accident, and is no longer able to move, call the Organizational Structure.

The Organizational Structure will send you a roadside assistance vehicle to where you are stopped.

The tow truck transports the vehicle from the place of immobilisation:

– to the nearest authorized Europ Assistance assistance centre,

– to the nearest assistance point of the Manufacturer or to the nearest mechanical workshop,

– at the point indicated by you as long as it is within 50 kilometers (round trip) from the stationary point.

Europ Assistance will pay the roadside assistance costs on your behalf up to the destinations listed in

precedence and within the foreseen mileage, for an accident.

Attention! Tire punctures and incorrect refueling are not considered breakdowns and/or accidents.

  • DEPANNAGE

If during the journey, the vehicle you are traveling with cannot restart:

– due to battery exhaustion or failure to start in general

– if you have lost your keys or they are broken

– for a tire puncture, you must call the Organizational Structure.

The Organizational Structure sends you a roadside assistance vehicle. The emergency vehicle repairs the vehicle on the spot, if possible.

Europ Assistance pays the expenses relating to assistance on your behalf, provided that the supplier is located within 20 km of the place where the vehicle is stationary. Otherwise the “Road Assistance” service intervenes.

ASSISTANCE FOR FAMILIES REMAINED AT HOME IN ITALY

  • MEDICAL ADVICE

When a family member of yours who has remained at home is ill or injured and needs to have his state of health assessed, he can call the doctors of the Organizational Structure and ask for a telephone consultation.

The family member must inform the Organizational Structure of the reason for his request and his telephone number.

This opinion is not a diagnosis.

  • SENDING A DOCTOR OR AN AMBULANCE TO ITALY

You can request this benefit only after a MEDICAL ADVICE has been requested for your family member.

If you are in Italy and one of your family members needs a medical examination or an ambulance, the Organizational Structure sends a chosen and approved doctor to his or her home.

  1. B) MEDICAL EXPENSE GUARANTEE

If while you are travelling, you have a sudden illness and/or suffer an accident, Europ Assistance will pay on your behalf the urgent medical, pharmaceutical/hospital expenses that cannot be postponed, incurred in the place of the accident, during the term of the Policy.

Europ Assistance pays the expenses on your behalf if the technical-practical conditions exist for the Organizational Structure to proceed. If this is not possible, Europ Assistance will reimburse these expenses under the same conditions, without applying the deductible.

In addition, Europ Assistance will pay on your behalf (if there are the technical-practical conditions to proceed) or reimburse you for urgent medical/pharmaceutical/hospital expenses that cannot be postponed, incurred at the place of the accident during the period of 15 days following the end of the booked Trip, which you must spend in the country where you are traveling because one of your Family Members or your Travel Companion has been directly affected by Covid-19.

Europ Assistance covers or reimburses medical expenses, per Insured Party and per claim up to the maximum amount indicated on Simplo Form 21177.

If you have been hospitalized

– until your resignation from the Healthcare Institute, or

– until the Europ Assistance doctors believe you can return to Italy.

If you have not been hospitalized,

– only the expenses you have incurred during the term of the policy and which the Organizational Structure has authorized you.

Within the limit provided for in Simplo Mod. 21177, Europ Assistance will pay you:

– hospitalization fees in a healthcare institution prescribed by the doctor up to the amount of Euro 250.00 per day per Insured.

– expenses for urgent and non-deferrable dental care necessary following an accident that occurred while traveling with a limit of Euro 250.00 per insured person;

– only in the event of an accident, the costs for prosthesis repairs up to the limit of Euro 250.00 per insured

– search and rescue expenses, up to Euro 500.00 per accident in Italy, the Republic of San Marino, Vatican City State and Euro 2,500.00 per accident abroad.

– only in the event of an accident, the costs for treatment you receive when you return to your residence, in the 45 days following the accident and up to a maximum of Euro 500.00.

Attention! There is a deductible for this guarantee. Consult the art. “Limitation of Warranties” of Section II.

  1. C) BAGGAGE GUARANTEE

1. LUGGAGE AND PERSONAL EFFECTS

Europ Assistance will compensate you for material and direct damage caused by:

– theft, burglary, mugging, robbery, fire;

and in the case of delivery to a carrier only

– bewilderment

– damage to your luggage including the clothes you were wearing when you left.

Europ Assistance compensates you. The value of the objects that make up your luggage with a limit of Euro 150.00 per object, including bags, suitcases and backpacks. Europ Assistance considers bags, suitcases and backpacks as a single object.

Within the limit indicated in the Policy Form, Europ Assistance will pay you per claim and per period of travel.

For journeys made by plane, train, bus or ship, the guarantee operates:

  • for Insured Persons residing in the European Union or in Switzerland from the departure station (airport,

railway, etc. of the organized trip) until the conclusion of the trip as organized by the Contractor;

  • for Insured Persons residing in countries outside the European Union from the date of arrival in one of the countries belonging to the European Union or in Switzerland until the date of departure from one of the same countries at the end of the trip.

Europ Assistance pays you per claim and per term of the Policy:

– up to 50% of the above ceiling, for:

– photocineoptical equipment and photosensitive material, radios, televisions, tape recorders, any other electronic equipment, musical instruments, personal defense and/or hunting weapons, diving equipment, eyeglasses or sunglasses.

Photokinetic equipment (camera, video camera, binoculars, flash, lenses, batteries, bags, etc.) are considered a single item.

– up to 30% of the above ceiling for

– cosmetics, medicines, sanitary items;

– jewellery, precious stones, pearls, watches, gold/silver/platinum objects, furs and other precious objects, only if you wear them or leave them for deposit at the hotel.

In addition to the limit, Europ Assistance reimburses you up to Euro 50.00 for the cost of having your identity card, passport and driving license redone in the event of theft, robbery or mugging.

Attention!

This guarantee includes an overdraft. Consult the art. “Limitation of Warranties” of Section II.

2. DELAYED DELIVERY OF BAGGAGE

You can request the Delayed Baggage Delivery guarantee if the carrier delivers your baggage more than 12 hours late in the case of confirmed scheduled flights and charter flights.

Europ Assistance reimburses you for unforeseen expenses that you have to make to buy necessary personal hygiene items and/or clothing. This up to a maximum amount of Euro 150.00 and only for delivery delays at the destination airport of the outward journey.

The ceilings are per Insured, per claim and per period of duration of the policy.

  1. D) INDEMNITY GUARANTEE FOR HOSPITALIZATION

If within 5 days of returning from your Trip you have been hospitalized for at least 7 consecutive days due to Covid-19 Europ Assistance

pays you an Indemnity of Euro 1,000.00 per Insured, per claim and per period of the Guarantee.

Indicate the countries where the accident occurred for which you can request guarantees.

They are divided into three groups:

  1. A) Italy, the Vatican City State and the Republic of San Marino;

VEHICLE ASSISTANCE SERVICES are provided in:

Italy, Republic of San Marino and Vatican City, Albania, Andorra, Austria, Belgium, Belarus, Bosnia Herzegovina, Bulgaria, Croatia, Mainland Denmark, Egypt, Estonia, Finland, France, Germany, Gibraltar, Greece, Ireland and Northern Ireland , Iceland, Israel, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Madeira, Malta, Morocco, Moldova, Monaco, Montenegro, Norway, Netherlands, Poland, Mainland Portugal, United Kingdom, Czech Republic, Romania, European Russia (excluding Ural Mountains), Serbia, Slovakia, Slovenia, mainland Spain and Mediterranean islands, Sweden, Switzerland, Tunisia, Turkey, Ukraine, Hungary.

Art. 3 – Effective date and duration of the guarantees

The guarantees start from the start date of the trip/stay and will be in force until the end of the same, or from the moment in which you start using the first contractually agreed tourist service and end with the complete completion of the last service foreseen by the contract itself.

The maximum duration of coverage during the period of validity of the Insurance is 30 consecutive days.

The Vehicle Assistance services will start from 48 hours prior to the Check-in time and will expire upon Check-in itself, at the booked facility or at the departure station. Subsequently it will start from the Check-out date, until the return to one’s residence and in any case within 48 hours.

Assistance services for family members left at home will start from the start date of your trip/stay and will be in force until the end of the same.

The indemnity guarantee for hospitalization starts from the date of your return and ends 5 days after the same.

Art.4 – Exclusions

  • GENERAL DISCLAIMERS APPLY TO ALL WARRANTIES

For all guarantees, claims caused by:

  1. willful misconduct or gross negligence except as indicated in the individual guarantees;
  2. by floods, inundations, volcanic eruptions, earthquakes, atmospheric phenomena having the characteristics of natural disasters, phenomena of transmutation of the nucleus of the atom, radiations caused by the artificial acceleration of atomic particles;
  3. war, strikes, revolutions, riots or popular movements, looting, acts of terrorism and vandalism.
  4. epidemics or pandemics as declared by the World Health Organization with the exception of Covid19;
  5. indirect consequences of the Covid 19 epidemic/pandemic.
  6. anything not indicated in art. “Subject of the Insurance” for the individual services/guarantees.

The following cases are also excluded:

– failure to comply with the ordinances/regulations imposed by the control bodies/host countries or countries of origin;

– the consequences due or attributable to quarantines or measures restricting freedom of movement decided by the competent authorities which isolate the Municipality/largest territorial areas in which you are during the Trip.

Except as indicated in the individual Guarantees, expenses due to or attributable to/consequent to quarantine or other restrictive measures of freedom of movement, decided by the competent International and/or local Authorities, are not insured, local Authorities meaning any competent authority of the country of origin or any country where you have planned your Trip or through which you are transiting to reach your destination.

Any travel undertaken to participate in races/competitions involving extreme activities and business trips is excluded.

EXCLUDED COUNTRIES: Travel to the following countries is not insured: Afghanistan, Cocos, South Georgia, Heard and McDonald’s, Bouvet Island, Christmas Island, Pitcairn Island, Chagos Islands, Falkland Islands, Marshall Islands, Minor Islands, Solomon Islands, Wallis and Futuna, Kiribati, Micronesia, Nauru, Niue, Palau, Western Sahara, Samoa, Saint Helena, Somalia, French Southern Territories, West Timor, East Timor, Tokelau, Tonga, Tuvalu, Vanuatu.

  • DISCLAIMERS RELATING TO INDIVIDUAL WARRANTIES
  1. A) ASSISTANCE WARRANTY

Claims dependent on or caused by:

  1. car, motorcycle or motorboat races and related trials and training;
  2. mental illnesses and psychic disorders in general, including organic cerebral syndromes, schizophrenic disorders, paranoid disorders, manic-depressive disorders and related consequences/complications;
  3. diseases dependent on pregnancy beyond the 26th week of gestation and on the puerperium;
  4. illnesses that are the expression or direct consequence of chronic or pre-existing pathological situations at the beginning of the trip;
  5. organ explantation and/or transplantation;
  6. abuse of alcohol or psychotropic drugs;
  7. illnesses/injuries resulting from the HIV virus;
  8. use of drugs and hallucinogens;
  9. not authorized to drive the vehicle in accordance with the provisions of the law in force;
  10. suicide attempt or suicide;
  11. aerial sports in general, driving and using hang gliders and other types of ultralight aerial vehicles, parachuting, paragliding

and similar, sledges, bobsleds, acrobatic skiing, ski or water ski jumps, mountaineering with rock climbing or access to glaciers, free climbing, kite-surfing, scuba diving, sports involving the use of vehicles and motor boats, boxing, wrestling in its various forms, martial arts in general, heavy athletics, rugby, American football, caving, acts of rashness, injuries suffered as a result of sporting activities carried out on a professional basis, however not amateur ( including competitions, trials and training).

Trips made against medical advice or with the aim of going to treat a disease that occurred before departure are also excluded.

FURTHERMORE, THE FOLLOWING EXCLUSIONS APPLY FOR THE INDIVIDUAL SERVICES:

  • SANITARY RETURN

They’re excluded:

– the illness or injury which allows you, according to the assessment of the doctors of the Organizational Structure, to continue travelling,

– the illness or accident that can be treated on the spot,

– infectious diseases, when transport does not comply with national or international health standards,

– resignation from the medical center or hospital against the advice of the doctors, by your choice or by the choice of your family members.

In the event of death they are excluded

– the expenses for the funeral, the search for people, the recovery of the body and other expenses that are not related to the

transport.

– The transport of the body to places that are not practicable with normal means of transport.

The transport, always in compliance with the laws in force, can be done with vehicles suitable for funeral transport (e.g. hearses). The return to the residence is excluded if you are not a resident of Europe and your trip has as destination a non-European country.

  • ROADSIDE ASSISTANCE

They’re excluded:

– costs for spare parts and all repair costs;

– the expenses for the intervention of exceptional means, when the exceptional means are necessary for the recovery of the

vehicle;

– towing costs, when the vehicle suffered an accident or breakdown while it was circulating off the public road network or in areas comparable to it (such as, for example: off-road routes).

Tire punctures and incorrect refueling are not considered breakdowns and/or accidents.

  • DEPANNAGE

They’re excluded:

– Costs for spare parts and all repair costs;

– the expenses for the intervention of exceptional means, when the exceptional means are necessary for the recovery of the

vehicle;

– towing costs, when the vehicle suffered an accident or breakdown while it was circulating off the public road network or in areas comparable to it (such as, for example: off-road routes).

  1. B) MEDICAL EXPENSE GUARANTEE

Claims due to:

  1. mental illnesses and psychic disorders in general, including organic cerebral syndromes, schizophrenic disorders, paranoid disorders, manic-depressive disorders and related consequences/complications;
  2. diseases dependent on pregnancy beyond the 26th week of gestation and on the puerperium;
  3. illnesses that are the expression or direct consequence of chronic or pre-existing pathological situations at the beginning of the trip;
  4. accidents resulting from carrying out the following activities: mountaineering with rock climbing or access to glaciers, ski or water ski jumps, driving and using sledges, aerial sports in general, driving and using hang gliders and other types of ultralight aerial vehicles , paragliding and similar, kite surfing, acts of recklessness as well as all injuries suffered as a result of sporting activities carried out on a professional basis, however not amateurish (including competitions, trials and training);
  5. organ explantation and/or transplantation;
  6. car, motorcycle or motorboat races and related trials and training;
  7. gross negligence;
  8. abuse of alcohol or psychotropic drugs;
  9. illnesses/injuries resulting from the HIV virus;
  10. use of drugs and hallucinogens;
  11. attempted suicide or suicide.

Furthermore, Europ Assistance does not pay you:

– all expenses incurred if you have not reported to Europ Assistance, directly or through third parties, the hospitalization or emergency services,

– expenses for the treatment or elimination of physical defects or congenital malformations, for applications of an aesthetic nature, for nursing, physiotherapy, spa and slimming treatments,

– the costs of dental treatment following a sudden illness,

– expenses for the purchase and repair of glasses, contact lenses,

– expenses for orthopedic and/or prosthetic devices following a sudden illness,

– follow-up visits in Italy for situations resulting from illnesses that began while travelling,

– the costs of transport and/or transfer to the Healthcare Institute and/or the place of your accommodation;

– medical expenses related to health checks for Covid-19 imposed by the country of destination upon arrival.

Trips made against medical advice or with the aim of going to treat a disease that occurred before departure are also excluded.

  1. C) BAGGAGE GUARANTEE

Furthermore, the following are not insured under the “Baggage and personal effects” guarantee:

  1. the case of theft of luggage loaded onto a motorcycle of any engine capacity during the journey;
  2. the damage caused to sports equipment during their use;
  3. the theft of sports equipment left unattended/not stored in locked places;
  4. the theft with dexterity;
  5. theft from the home;
  6. the case of theft of baggage on board the vehicle.

Furthermore, the following are not insured:

  1. mobile phones, MP3 players, personal computers, tablets.
  2. money, checks, stamps, tickets and travel documents, souvenirs, coins, works of art, collections,

samples, catalogues, goods, documents other than identity cards, passports and driving licences;

  1. helmet, professional equipment;
  2. goods other than clothing, which have been delivered, even together with the clothing, to a transport company, including the air carrier;
  3. the fixed and service accessories of the vehicle itself (including removable radio or player).

The following are also excluded from the “DELAYED DELIVERY OF BAGGAGE” guarantee:

  1. the case of delayed baggage delivery at the airport of the city of departure at the beginning of the journey;
  2. all expenses you incur after receipt of the baggage.

Art.5 – International Sanctions

Europ Assistance Italia SpA is not required to guarantee the insurance coverage and is not obliged to pay the Indemnity and/or Compensation or to recognize any benefit provided by these Insurance Conditions if the provision of such coverage, the payment of such Compensation or the acknowledgment of this benefit exposes Europ Assistance Italia SpA to sanctions, prohibitions or restrictions envisaged by resolutions of the United Nations or to commercial, economic sanctions or revocatory measures determined by laws or regulations of the European Union or the USA. This clause will prevail over any contrary clause contained in these Conditions of Insurance.

The policy is not applicable in the following countries: Syria, North Korea, Iran and Venezuela and in the Crimea

Attention!

If you are a “United States Person” and you are in Cuba, in order to obtain the assistance, Indemnification/Compensation provided for in the Policy you must demonstrate to Europ Assistance Italia SpA that you are in Cuba in compliance with US laws.

Without authorization for your stay in Cuba, Europ Assistance Italia SpA cannot provide assistance and pay you compensation/compensation.

Art.6 – Limitations of guarantees

  • TRAVEL RESTRICTIONS

You are not covered if you travel to a country, region or geographical area for which the competent governmental authority in your country of residence or in the destination or host country has advised against traveling or otherwise residing, even temporarily.

  • CONTINUED STAY ABROAD

You can stay abroad for a maximum of 30 consecutive days during the validity of this Policy. You will not be insured for claims that occur after 30 days.

  1. A) ASSISTANCE WARRANTY
  • INTERVENTION LIMITS

Europ Assistance does not provide you with the Services in those countries which are in a state of declared or de facto war, including those whose state of war has been made public. Countries that are listed on the website https://www.europassistance.it/paesi-in-stato-di-belligeranza with a degree of danger equal to or greater than 4.0 are considered as such. Furthermore, Europ Assistance cannot provide you with assistance services in countries where the local or international authorities do not allow it to intervene on the spot even if there is no risk of war.

  • BENEFIT PROVISION LIMITS

Assistance benefits are provided up to once per insured person, of each type within the duration of the trip.

  • LIMITATION OF LIABILITY

Europ Assistance will not have to compensate for damages:

– caused by the intervention of the authorities of the country in which the assistance is provided,

– consequent to any other fortuitous and unforeseeable circumstance.

It should also be noted that the operation of the services is in any case subject to the limitations and provisions imposed by the government, local and health authorities.

  1. B) MEDICAL EXPENSE GUARANTEE
  • DISCOVERY AND DEDUCTIBLES

Europ Assistance applies a deductible only when you have not been hospitalized and in cases of reimbursement. The absolute deductible is Euro 50.00.

  1. C) BAGGAGE GUARANTEE
  • DISCOVERED

Europ Assistance applies a 50% overdraft if:

– you forget your luggage, do not take care of it or lose it,

– if they steal the whole vehicle in which you put your luggage,

– if they steal the things you put in your tent. However, you must be in a regularly equipped and authorized campsite.

-Example of deductible:

if the agreed deductible is equal to a fixed sum of Euro 50.00:

expenses of less than Euro 50.00 will not be indemnified/compensated

expenses exceeding Euro 50.00 will be reimbursed with the deduction of Euro 50.00 (within the limits of the established ceilings).

Art.7 – obligations of the insured in the event of an accident

FOR ALL WARRANTIES OTHER THAN ASSISTANCE

You will have to report the accident in the following ways:

– by accessing the portal https://sinistrionline.europassistance.it or the website www.europassistance.it in the section

CLAIMS. You must follow the instructions.

Or

– by writing a registered letter with return receipt to Europ Assistance – Claims Liquidation Office (indicating the guarantee

for which you report the claim) – Piazza Trento, 8 20135 Milan.

You must provide the following data/documents:

– your name, surname and address

– your phone number;

– Europ Assistance card number + case number;

– the circumstances of the event;

– the date of occurrence of the accident;

– place where you or the people who gave rise to the accident can be found.

The times for reporting the accident are indicated in the individual guarantees.

IN ADDITION TO THIS, FOR EACH WARRANTY YOU MUST GIVE US OTHER INFORMATION/DOCUMENTS AS INDICATED BELOW:

  1. A) ASSISTANCE WARRANTY

Always call the Organizational Structure of Europ Assistance on the number: +39 02.58286532 from Italy or

from abroad. The Organizational Structure is active 365 days a year, 24 hours a day.

Do nothing without first contacting the Organizational Structure.

In an emergency, call the Emergency Services. If you do not contact Europ Assistance, it will not guarantee you services. The art. applies. 1915 of the Civil Code.

  1. B) MEDICAL EXPENSE GUARANTEE

After calling the Organizational Structure on the number: +39 02.58286532 from Italy or from abroad, you must file a report no later than sixty days after you had the accident.

You must send the following data/documents:

– the First Aid certificate written at the scene of the accident which indicates the pathology suffered or the medical diagnosis certifying the type of accident suffered and how it happened;

– the certified copy of the original of the medical record, if you have been hospitalised;

– originals of invoices, receipts or tax receipts for the expenses incurred, complete with the tax data (VAT or Tax Code) of the issuers and holders of the receipts themselves;

– medical prescription for the purchase of medicines with the original receipts of the medicines purchased;

– Covid-19 positivity test report (swab and/or serological test).

  1. C) BAGGAGE GUARANTEE

WHAT SHOULD YOU DO IN THE EVENT OF BAGGAGE PROBLEMS?

You must remember to

– in the event of theft/loss, immediately report to the competent authorities of the place where the accident occurred and keep a certified copy for Europ Assistance;

– send a written complaint to the hotelier or carrier or other responsible for the damage;

– in the event of the carrier’s liability, file a complaint according to the procedures indicated by the carrier at the time of the accident;

– within 60 days of the occurrence of the accident, send a report of the accident to Europ Assistance by accessing the portal https://sinistrionline.europassistance.it or using the methods listed below

It is important to keep all the documents to be presented to Europ Assistance together with the claim report and carefully read the methods listed below.

You must report the accident within sixty days of when you suffered it and send the following data/documents:

For the “Baggage” guarantee you must send the following data/documents:

– copy of the travel tickets or the details of the stay;

– certified copy of the report with the visa of the Police Authority of the place where the fact occurred;

– the circumstances of the event;

– the list of lost or stolen items, their value and date of purchase;

– the names of the Insured Party who have suffered the damage;

– copy of the letter of complaint presented to the possibly responsible hotelier or carrier;

– justifications of the costs of redoing the documents, if incurred;

– copies of invoices, receipts or tax receipts, complete with the tax data (VAT number or tax code) of the issuers and holders of the receipts themselves, proving the value of the damaged or stolen goods and their date of purchase;

– repair invoice or declaration of irreparability of damaged or stolen goods drawn up on paper

headed by a dealer or a specialist in the sector.

Only in the case of non-delivery and/or damage to all or part of the baggage delivered to the carrier must you attach to the refund request:

– copy of the report made immediately to the Office specifically assigned to claims for lost luggage;

– copy of the complaint letter sent to the carrier with the request for compensation and the carrier’s response letter.

For the “Delayed Baggage Delivery” guarantee, you must send the following data/documents:

– a declaration from the airport management company or the carrier certifying the delayed delivery of the baggage beyond 12 hours and the time of delivery;

– copies of invoices, receipts or tax receipts, complete with the tax data (VAT or Tax Code) of the issuers and holders of the receipts themselves, proving the value of the goods purchased;

– copy of the complaint letter sent to the carrier with the request for compensation and the carrier’s response letter.

  1. D) INDEMNITY GUARANTEE FOR HOSPITALIZATION

You must make a report no later than sixty days after you had the accident.

You must send the following documentation:

– certificate of discharge from the hospital where you were hospitalized for Covid-19 showing the reason and duration of hospitalisation.

For claims management of all guarantees:

Europ Assistance may ask you for other documents necessary to evaluate the claim.

You are obligated to give them to them.

If you fail to meet your obligations in the event of an accident, Europ Assistance may decide not to reimburse you.

This is established by the Civil Code in art. 1915.

Art. 1915 Italian Civil Code: the article explains what happens to the Insured if he does not report the claim to his insurer within the times in which he requested it.

The insurer is required to indemnify the Insured for a sum equal to the damage that the Insured has suffered.

If the Insured behaves deliberately in such a way as to cause or aggravate the damage, the insurer may not pay it.

If the Insured involuntarily causes or aggravates the damage, the insurer may pay less.

Art.8 – criteria for the liquidation of the damage

  • PAYMENT OF INDEMNITY

For all Guarantees with the exception of Assistance Europ Assistance, after receiving the necessary documentation from you, after verifying the operation of the Guarantee and after having made the necessary checks, establishes the Compensation/per diem/reimbursement due to you and notifies you.

Europ Assistance will pay you within 20 days of this communication. In the event of death before Europ Assistance has paid you the indemnity/per diem/reimbursement, your heirs will be entitled to the payment that would have been due to you only by demonstrating the existence of the right to the indemnity/per diem/reimbursement by delivering the documentation to Europ Assistance request to art. “Obligations of the Insured in the event of an accident”.

  1. C) BAGGAGE GUARANTEE
  • CRITERIA

If a carrier/hotelier is responsible for damage to your luggage, Europ Assistance will pay you, up to the maximum amount set out in the Policy, integrating the part already reimbursed by the carrier/hotelier responsible for the event.

In the case of items purchased no later than three months before the occurrence of the accident, the refund will be made based on the purchase value, if proven by the relative documentation. In the case of objects purchased more than three months before the occurrence of the accident, the degradation of use of the same will be taken into account.

In the event of damage, the cost of the repair will be refunded upon presentation of the invoice.

Under no circumstances will so-called affective values ​​be taken into account.

Premise

These terms and conditions govern the offer and sale of Villago srl V-BOXES. – with headquarters in Merone, via Segantini, 11 – 22046, registered in the register of companies of Como under no. CO-313845, tax code and VAT number no. 03420530135 – on the website www.villago.it , on other web addresses that redirect to villago.it (Villago.it) and through any other channel.

The V-BOX Terms and Conditions are supplemented by the Villago srl General Terms and Conditions of Sale which are understood to be referred to herein and fully applicable to the purchase and use of the Villago srl V-BOX

General provisions

The V-BOXES presented on the website www.villago.it were created and are marketed by the company Villago srl with headquarters in Merone (CO), 22046, via Segantini n.11. The website www.villago.it illustrates the products and services created by Villago srl, including in particular the V-BOXES, with an indication of the conditions and methods of booking the stay and the tourist services provided therein.

  1. OBJECT

The “V-BOX” is a Villago srl product and is marketed online. This product offers its beneficiary the possibility of staying for one or more days in an historic Italian residence and of having one or more related experiences.

The registration and booking of the V-BOX must take place within 24 months of the purchase of the V-BOX itself, unless otherwise provided or agreed directly with Villago srl, and is subject to the prescriptions and limitations hereinafter better identified.

Each V-BOX is presented on the website www.villago.it with a progressive number and is identified by an alphanumeric serial code, which will be generated for the purchaser at the time of purchase. The latter must be communicated by the beneficiary (by accessing the reserved area on www.villago.it and/or via email at [email protected]) to Villago srl in order to register and simultaneously book the stay and the planned experiences.

In any case, the purchase of the product and/or the reservation of the services contained therein imply the acknowledgment and full acceptance of the conditions of sale and operation of the “V-BOX”.

  1. GENERAL TERMS AND DEFINITIONS

These terms and conditions relating to the “V-BOX” apply only to the Villago V-BOX and not to the other products sold by Villago srl, regardless of the method of purchase.

The purchase of the product and the booking of the service involve the prior viewing and full acceptance of the terms and conditions provided for the V-BOX. To better understand how the product works, the reference definitions are specified below:

  • V-BOX di Villago (V-BOX): indicates a pre-packaged thematic package offered online, consisting of a stay of one or more nights in an Italian historical residence and one or more tourist experiences related to the historical residence or theme of the package itself. It is sold on the website www.villago.it, shop/V-Box section, each V-Box purchased generates a Code (as defined below), which will allow the beneficiary-owner to make the trip and use the related services. Villago srl reserves the right to expand and modify the list of available V-Boxes or to cease their distribution at its own discretion and at any time.
  • Customer or Buyer: the person who buys the V-BOX
  • Beneficiary: the person who, in possession of the alphanumeric code, requests the use of the V-BOX by registering and booking the services provided
  • Partners: the suppliers of the services included in the V-BOXes
  • Alphanumeric code: indicates a non-nominative legitimacy that allows the Beneficiary, owner of the code (as defined below), to book and carry out the trip made by Villago srl and associated with the V-Box purchased by the Purchaser (as defined below ).
  • Product: indicates the thematic package supplied directly by Villago srl. In this case, Villago srl is the Service Provider.

If one of the conditions of sale indicated here is missing in whole or in part, this does not affect the validity and/or effectiveness of the other provisions or agreements unless otherwise provided.

Villago srl reserves the right to modify the conditions of sale at any time, without notice, it being understood that any modifications will not have a retroactive nature.

The content, services, terms and conditions of enjoyment of the tourist services illustrated in the reference V-BOX are objectively predetermined and accepted upon purchase of the product and also apply to the beneficiary of the product.

  1. SCOPE AND LIMITS OF APPLICATIONS

3.1 Territoriality

These conditions, as well as the contract concluded on the occasion of a sale of a V-BOX or a reservation of the tourist service provided therein, are subject to Italian law. In the event of a dispute, jurisdiction rests with the Italian Judge.

3.2. Capacity

All customers who purchase or book online formally declare that they possess all the ability to understand and want to purchase and book on www.villago.it in accordance with the conditions of sale. The customer declares himself financially responsible for the use of the site on his behalf or on behalf of third parties, including minors under his guardianship, without prejudice to the possibility of demonstrating that there has been a fraudulent use not attributable to his negligence.

The information communicated by the customer or the intermediary who uses this personal data will be considered true. Any use of the site www.villago.it in violation of these conditions may imply the refusal by Villago srl to accept the order and/or to access the services requested, including the legitimate refusal to confirm any reservation in this regard .

The customer can purchase the “V-BOX”:

  2. b) By telephone contact on the number at no. 3383090011, which must be followed by a written request email to [email protected].

The procedure for purchasing a V-BOX is as follows:

View and choose the V-BOX you wish to purchase for yourself or to give to third parties from the list of V-BOXes on the website www.villago.it. If you are interested in making the V-BOX on a specific date, request the availability of the V-BOX for that date, before proceeding with the purchase, either by sending an email to [email protected] or by contacting Villago on telephone 3383090011.

Formalize the purchase by following all the steps indicated on the website www.villago.it . Indicate the type of payment and proceed to confirm the purchase. The sale is considered completed subject to successful completion of the payment transaction.

Following the purchase of the V-BOX, according to the aforementioned methods, the system will generate an alphanumeric code linked to the purchased V-BOX. This code can be used by the purchaser himself (purchaser-beneficiary) or by the beneficiary, if different from the purchaser, to register himself and the other participants and reserve the date and moment for the execution of the V-BOX and his experiences. Once the participants have been registered and the envisaged reservations have been made, the alphanumeric code will identify the registered persons, will be disabled in relation to third parties and can no longer be used by others to make further registrations and subsequent reservations. The stay and experiences of the V-BOX can be booked and carried out within 24 months of the purchase of the V-BOX itself.

The V-BOX purchased and its identification alphanumeric code can be obtained electronically at the end of the online purchase procedure. Otherwise, only at the buyer’s request, the V-BOX purchased with the relative code can be physically sent, in the form of a letter with sealing wax, with the packaging chosen by Villago, to the address indicated by the buyer.

The methods of registration and subsequent booking are indicated subsequently in art. 18.

  1. PRICES AND PAYMENT CONDITIONS

Prices are indicated in euros and are those in effect at the time of purchase. The price does not include any transport/shipping costs for the package which will be indicated, if the shipment is specifically requested, as a supplement in the summary of the products purchased in the cart, before proceeding with the confirmation. Customers have the following payment methods:

  • By Credit Card (Visa, Mastercard, American Express, etc…) with transactions guaranteed by the Stripe System;
  1. PROCESSING OF PERSONAL DATA

The processing of personal data is carried out both in paper form and in digital form, in full compliance with Legislative Decree 196/2003, for the purpose of concluding the contract and for the execution of the services which form the object of the tourist package. The provision of data is necessary for the purpose of stipulating the contract and accepting the purchase order.

Personal data will not be disclosed to third parties without prejudice to the communication obligations established by law and/or by the Authority or the suppliers of the services making up the tourist package purchased (for example, the bank for payment or the accommodation facilities that provide the chosen tourist service).

Villago srl may request the explicit consent of the customer for other advertising, promotional and/or marketing purposes, in order to improve the quality and modulation of the service. In this case it is up to the customer to issue or not the appropriate consent. The personal data controller is Villago srl, Via Segantini, 11 – 22046 Merone (CO), in the figure of its legal representative pro tempore.

Interested parties may, at any time, exercise the rights pursuant to art. 7 of Legislative Decree 196/2003, requesting the rectification and/or cancellation of data, by contacting Villago srl, as data controller.

  1. DATA OF THE PURCHASER AND THE RECIPIENT

When purchasing the product, it is up to the customer to communicate the data required for acceptance of the purchase order. In case of shipment of the product to the address indicated by the customer, it is the latter’s responsibility to verify that the recipient’s address and data are all correct.

The liability of Villago srl is excluded for any delays and/or non-delivery of shipments due to incorrect indications by the buyer. In the event that the V-BOX is not delivered, it is the customer’s responsibility to contact the number 3383090011 or write an email to [email protected] for the necessary checks. If the customer does not communicate the non-delivery within the term indicated by Villago srl, the shipment is considered successful and/or the customer (or the third recipient of the box) loses the right to request a new shipment for any problems in receiving the packaging.

  1. ANTI-FRAUD PRECAUTIONS IN THE EVENT OF SUBTRACTION, LOSS OR LOSS OF THE PRODUCT

In consideration of the fact that the beneficiary of the V-BOX can also be a person other than the customer who purchased it, since the right to use the tourist service derives from the availability of the alphanumeric serial code generated at the time of purchase, it is up to the customer to exercise the utmost diligence in custody of the code. In any case it should be noted that Villago srl has created a

control procedure to limit fraud as much as possible and to protect the buyer in the event of theft.

In the event of non-delivery of the V-BOX, if requested in physical-paper form, it is possible to trace and trace the number of the lost V-BOX, making the booking code unusable.

It is the responsibility of the customer (and/or the authorized reseller) to report any possible loss and/or loss of the purchased V-BOX (identified by the alphanumeric code), both in digital format and in paper format, in order to allow the same code to be deactivated and/or can be replaced if necessary. This communication, implying the assumption of responsibility, must be formalized in writing and signed by the declarant.

  1. ASSISTANCE AND CUSTOMER SERVICE

Villago srl provides its customers (as well as the beneficiaries of the product) with an assistance and information service by telephone on 3383090011 or by email at [email protected].

Any conduct put in place by the customer and/or by the beneficiary of the service in a way that does not comply with the contractual obligations (and/or with the indications provided by the customer service) must be considered incorrect and not deserving of protection since, in the event of difficulty in interpreting and/or needs of any kind, it is always possible to contact the assistance service for clarification of the case.

  1. LIABILITY RELATED TO THE USE OF THE WWW.VILLAGO.IT SITE

The customer acknowledges and unconditionally accepts that Villago srl, also in consideration of causes of force majeure and/or facts attributable to third parties, cannot guarantee the perfect continuity of the service provided through the website www.villago.it.

In the event of interruption or incompatibility of the site with the customer’s computer systems, any disservices deriving from it can in no case be attributed to the responsibility of Villago srl.

  1. INTELLECTUAL PROPERTY

Villago is a registered trademark. The use of this distinctive sign by third parties is permitted only in the cases and within the limits expressly authorized by Villago srl.

  1. SPECIFIC CONDITIONS OF SALE

The customer (and/or the beneficiary of the “V-BOX”) acknowledges that the product can only be validly used against the regular sale, after registration and booking through the website or the Villago contacts.

Unless otherwise established, in relation to the products sold directly by Villago srl on its website, all those that are regularly presented and available as described on the www.villago.it portal can be purchased.

Except in the case of momentary unavailability, all V-BOXes ordered/purchased by the customer, if expressly requested, will be delivered to the address communicated by the buyer within 72 hours of order confirmation, otherwise they can be sent to the email address shown in digital format. If the V-BOX is temporarily unavailable, the customer will be informed by Villago srl and, if he does not intend to wait for delivery, he will have the possibility to request a refund which can take place within 30 days of the request.

  1. SHIPPING COSTS AND DELIVERY TIMES

When purchasing the product, the customer must communicate whether he intends to receive the V-BOX and the relative alphanumeric code directly online to the indicated e-mail address, or if he wishes it physically in paper format to the postal address. In this case, the customer must correctly provide all the data necessary for the shipment.

The V-BOX will be sent to the address indicated in the appropriate reference field, as indicated by the purchaser. Shipping costs are free throughout the national territory. For shipments abroad, the customer must contact Villago srl at the e-mail address [email protected] to verify the exact amount of the shipment.

The physical-paper V-BOXES are sent via a national courier. For requests received before 12.00 the shipment will take place the same day, for requests received after 15.00 the shipment will take place the following day. Delivery times may vary from 48 to 72 hours from the time the order is shipped. Shipments are not made on Saturdays and Sundays and on holidays and days before holidays.

Villago srl will not be responsible for non-delivery, but will nevertheless do everything possible to trace what happened and identify the package.

  1. RIGHT OF WITHDRAWAL

The customer can exercise the right of withdrawal within 14 working days of receiving the goods, without having to justify the reason and without having to pay any penalty. The right of withdrawal is valid only for V-BOXes purchased online on the website www.villago.it , or for V-BOXes purchased directly from Villago srl, upon request, by phone call or dedicated email.

The withdrawal is validly exercised against the timely return of the paper package received by post or following the request for return/cancellation of the V-BOX, with code, sent by email. In case of return of the paper package, the same must be sent to the sender with expenses entirely borne by the customer who withdraws.

The right of withdrawal is conditional on the return of the package perfectly intact, in all its parts, if the physical-paper purchase had taken place. Once the integrity of the product has been verified, Villago srl will reimburse the amount paid, keeping the cost for shipping costs as indicated above. The refund of the money will take place no later than 30 days from the receipt of the returned V-BOX.

  1. VALIDITY AND TERMS OF USE OF THE PRODUCT

Each V-BOX is valid and usable within 24 months from the date of purchase. The beneficiary must take advantage of the stay and the experiences provided in the V-BOX no later than 24 months from the date of purchase. After these terms, the right to use the V-BOX package itself will be lost.

The customer and the beneficiary of the product with their own care and diligence are required to observe and check the expiry date of the product.

The chosen tourist service is valid for two people or more people, according to the provisions in the specific V-BOX, and exclusively includes the services expressly described in the V-BOX indicated on the website www.villago.it . Ancillary services or other tourist services are not included and may be subject to charges.

In case of discrepancy between the information contained in the paper V-BOX and the online V-BOX, the information published on the website will be considered valid.

  1. REFERENCE REGULATION

The sale of tourist packages, which have as their object services to be provided both nationally and internationally, is regulated – until its repeal pursuant to art. 3 of Legislative Decree no. 79 of 23 May 2011 (the “Tourism Code”) – by Law 27/12/1977 n° 1084 ratifying and executing the International Convention relating to the travel contract (CCV), signed in Brussels on 23.4.1970 – in as applicable – as well as the Tourism Code (articles 32-51) and subsequent amendments.

Villago srl owns authorization no. CO-313845 d reg. dated 09/25/2013 by the Province of Como for carrying out the activity of Tour Operator. The Consumer Code also applies as required by law.

  1. AVAILABILITY OF THE OFFER

The customer/beneficiary unconditionally acknowledges and accepts that the tourist services chosen and/or contained in the V-BOX (stay and experiences) may not be available on the chosen date. For this reason, the customer/beneficiary can request availability for a specific date before purchasing the V-BOX, or, once purchased, has time to make the trip 24 months from the date of purchase, so as to be able to book also at distance of time the package (V-BOX) purchased.

The reservation and/or request to use the V-BOX on a certain date is subject to the restrictions specified below (in summary: availability of the structure; minimum reservation terms that must be respected; reference periods for closed dates and/or or high season which have reservation limits). In any case, the customer/beneficiary acknowledges and accepts that the temporary unavailability of an accommodation facility and/or an experience in a given period of time does not imply a breach by Villago srl.

For reasons beyond the control of Villago srl, some structures and/or experiences could be modified or canceled from the programming. In this case, the V-BOX must be replaced with other V-BOXes equivalent in value, subject to adjustments in excess or deficit with respect to the purchased V-BOX.

16.1 Restrictions and Availability Limitations

Each V-BOX is highly themed and consists of one-of-a-kind stays and experiences, which cannot be replaced or changed with stays and experiences from other V-BOXes. If the customer/beneficiary wishes to replace his V-BOX, he can replace it with another of equal or higher value, integrating the cost, again within 24 months of the purchase.

For the above, the customer/beneficiary of the service acknowledges and unconditionally accepts that the accommodation facilities indicated by Villago srl have limited availability, are subject to availability and that it is therefore necessary to book well in advance, especially in periods of high season.

The minimum booking term is at least 7 days before the travel start date and may vary depending on the V-BOX; however, some accommodation facilities may require a longer term and this even if it is not the high season, others a shorter period to be verified at the time of booking.

The structures proposed in the V-BOX may observe periods of closure and/or may exclude certain services, conditioning their availability in certain days/periods. It is the responsibility of the beneficiary of the services to verify the full usability of the services at the time of booking, agreeing with Villago srl the methods and times for using the services (stays and experiences).

In case of lack of availability of the structure, the beneficiary has the right to choose other dates that result in the availability at the time of booking.

If, for reasons beyond Villago srl’s control, the structure or any other service included in the stay is no longer available despite the written confirmation via email, Villago srl will inform the customer as soon as possible, who will be able to choose from the following alternatives:

  • Find an alternative date for the requested structure
  • Request another V-BOX of equal or greater value

In addition to the purchased V-BOX, other V-BOXes are available on the website www.villago.it

In case of discrepancy between the information contained in the information sheet inside the V-BOX and the description of the online offer, what is published on the website will be considered valid.

Villago srl has the right to interrupt the collaboration with any partner at any time without having to provide specific communication, without prejudice to the possible re-protection of already accepted reservations.

In this case Villago srl undertakes to comply with the quality standard required for the type of product involved in the change.

  1. V-BOX which include stays of one or more nights

The service is not based on the use of a contingent of rooms contracted by Villago srl with each structure described on the site. The availability of the accommodation facilities can be verified either by contacting Villago srl directly; otherwise, the customer/beneficiary will have to adapt to the availability of the facility. For this reason, Villago srl provides 24 months to book the experience.

Unless otherwise specified, reservations must be made with a minimum of 7 working days for all V-BOXES that include overnight stays. Reservations outside these terms are not accepted, except by making a specific request directly to Villago srl.

It is recommended to consult the website www.villago.it and register the participants of the V-BOX by entering the alphanumeric code generated by the purchase of the V-BOX. You will then have the opportunity to book your stay and the experiences provided in the V-BOX by filling in a specific form provided by the system. You can consult the information sheet with the details of the services included in the package and then proceed directly online with the reservation by sending the request to Villago srl.

Unless otherwise specified, the type of rooms provided in the V-BOX is double. Any request of a different type, therefore triple or quadruple, generates a request from Villago srl to the chosen structure: this request must be managed by contacting Villago srl by mail or by telephone on 3383090011 and is subject to confirmation by the structure involved. Payment of any difference in price requested is to be paid to Villago srl by credit card.

In conjunction with high season periods and/or on the occasion of fairs and events, availability could end even several weeks in advance and therefore it is advisable to book well in advance.

In case of lack of availability, the beneficiary has the right to choose alternative dates or different V-BOXES of the same or higher price. Some of the proposed structures may observe periods of seasonal closure (e.g. structures in purely summer destinations that close in the winter months). Likewise, some services or experiences that are part of the chosen package may not be available every day of the week. (e.g. tastings, visits, etc.). The beneficiary has the right to choose alternative experiences available, which will eventually be presented at the time of booking, for the requested dates or change the date.

Any activities or practical experiences included in the V-BOXES are subject to the weather conditions necessary for carrying out the specific activity. In the event of the impossibility of carrying out even just one part of the planned activity, Villago srl will not be held responsible and it will not be possible to obtain any type of refund. It will be possible to agree directly with Villago srl to carry out the activity at another time of the stay or to change the activity/experience with another similar and equivalent one. It will not be possible to extend the duration of the V-BOX or repeat stays or experiences that have already been used.

  1. REGISTRATION OF PARTICIPANTS AND SIMULTANEOUS BOOKING OF THE STAY and EXPERIENCES CONTAINED IN THE PURCHASED V-BOX

Once the V-BOX has been purchased and possession of the consequential alphanumeric code, the beneficiary will have to register the participants expected for the V-BOX purchased and proceed with the simultaneous booking of the date and services, following the instructions indicated on the system form or by contacting Villago srl directly. During registration and booking, the beneficiary will have to fill in a form predefined by Villago in which he will have to indicate up to four dates in which he wishes to carry out the V-BOX, the moments in which to carry out the experiences foreseen in the same, choosing from options pre-established by Villago . It must also indicate any specific needs and food problems.

Once the registration of the participants and the reservations have been received, Villago srl, having evaluated the availability, will confirm with a specific document (V-BOX confirmation voucher) the precise date for making the V-BOX and the detailed reservations of the stay and of the experiences foreseen in the V-BOX itself, thus confirming one of the dates indicated or requesting other dates as those requested are not available. Specifically, the confirmation document will define the dates in which the V-BOX must be carried out, based on the availability of the structures, and the moments in which to carry out the single planned experiences. Villago reserves the right, in the event of special problems or misunderstandings, to contact the beneficiary by telephone for detailed evaluations and reservations. Even the beneficiary

If the dates indicated in the booking form are not available, the beneficiary will be asked for other dates to carry out the V-BOX. The latter will not have the right to ask Villago for any type of compensation or refund of the cost of the V-BOX due to unavailability of the structure, but will only be able to request some new dates, until availability coincides.

This confirmation document sent by Villago will summarize the methods of making the V-BOX and will in fact represent the travel contract. The dates and times indicated in the voucher, deriving from the reservations made, must be respected by the beneficiary; they can be modified, based on the availability of the structure and of the operators who will create the individual experiences, up to a maximum of 7 days before the trip. After this deadline, it will no longer be possible to request changes to the scheduled dates and times. In the event that the dates and times cannot be changed due to the unavailability of an accommodation facility or an operator who carries out the experiences, the beneficiary must carry out his services on the dates and times booked, or request other dates or other times always within 7 days before the trip. Beyond this term, the beneficiary will not be entitled to any reimbursement either for the non-use of the accommodation facility, or for any single experiences not lived.

The envisaged registration of participants can take place:

Online on the website www.villago.it , in the special section dedicated to V-BOX registrations, following the instructions presented by the system, filling in a dedicated form and entering the alphanumeric code generated by the system when purchasing the V- BOX. The beneficiary who is different from the purchaser must receive from the latter the alphanumeric code useful for registering and subsequently booking the package.

The registration procedure will ask for all the necessary data of all participants in the thematic tourist package (V-BOX). Reservations will only concern the details provided for the accommodation facility and the experiences provided in the V-BOX. In the case of additional services, additional payment by credit card will be required.

It is the end customer’s responsibility to ensure that the information indicated during registration and subsequent booking is correct, in order to receive the confirmation document (voucher) relating to the booked V-BOX in good time.

18-BIS – THE CONFIRMATION DOCUMENT (CONFIRMATION VOUCHER) OF THE RESERVED V-BOX

After the agreed detailed reservations, within the following 24 hours, Villago srl will send the beneficiary the confirmation document (voucher), with the summary of the V-BOX to be made and all the services booked, including all the travel documents that must be verified promptly. In the event that the customer finds any inaccuracies, he must immediately contact Villago srl to inform of the error and/or ask for clarification. In case of non-receipt of the same, it is the customer’s duty to contact Villago srl to verify the reason for non-receipt and possibly provide the correct data; in the event of non-communication by the customer, the responsibility for the non-receipt of the confirmation document (voucher) and travel documents is attributable to him.

The confirmation document (voucher) sent is a confirmation of the trip and, as such, is to be considered binding and assumes the unreserved acceptance of the conditions of sale. This document can be used to access the accommodation facility or the services booked, and constitutes proof of payment and consequent detailed booking of the same.

Please note that the reservation of the stay can be made with a minimum of 7 working days for all the V-BOX of Villago srl.

Compared to what is published on the website www.villago.it, for reasons beyond the control of Villago srl, some accommodation facilities could be modified or canceled from programming and replaced with alternatives of equal quality (where possible).

  1. V-BOX CHANGE

It is possible to exchange a purchased V-BOX provided that it is still valid, i.e. within 24 months of purchase, and the services have not already been booked. In this case, it will be possible to change the date within 7 days of the trip, but not the thematic tour package (V-BOX). The expiry date of a V-Box can be verified by contacting Villago srl at [email protected].

Exchange is possible under the following conditions:

  • The exchange can take place no later than 24 months from the purchase of the V-BOX
  • The change can only be made once.
  • It is possible to exchange with one or more V-BOXES of the same or higher amount. If the new V-BOX chosen is for a lower amount, the difference will not be refunded.
  • In the event of a greater difference between your V-BOX and the new one, this must be paid by credit card, or other payment methods indicated at the time of purchase.
  • The new V-BOX will follow the validity of the previous one, i.e. 24 months are considered from the purchase of the first V-BOX, therefore the remaining months will be calculated with respect to the moment of purchase.
  • The old V-BOX will be canceled and the new one will be sent to the address indicated by the customer.

No additional cost will be charged for changing the V-BOX, except for the higher value of the new V-BOX.

Shipped physical V-BOXES may be exchanged for both physical and digital format V-BOXES, while digital V-BOXES may only be exchanged for digital format V-BOXES.

Once the exchange procedure has been carried out, the alphanumeric code of the changed V-BOX will no longer be usable.

  1. MODIFICATION AND CANCELLATION OF THE RESERVATION

All changes and/or cancellations of reservations made that include the stay must be sent in writing via email to [email protected] without which the request will not be taken into consideration and the file will remain confirmed as originally.

Changes and cancellations are subject to the following rules:

  • It is possible to cancel the thematic package (V-BOX) already booked, maintaining the right to make a new booking, no later than 7 working days before the start date of the stay, after this deadline the right to another booking will be lost and no may request a refund.
  • It is possible to change the start date of an already booked stay and/or the experiences booked no later than 7 working days before, after this deadline the right to the booking will be lost.
  • It is possible to change the name of the participants up to 2 working days before the trip.

It is advisable to check from time to time between the specifications of the V-BOX or of the structure if special conditions relating to the cancellation or modification of the reservation should apply.

  1. COMPLAINTS

All complaints must be sent by email to [email protected] or by registered mail with acknowledgment of receipt, no later than 10 days from the return of the stay and must be addressed to:

The delay in the complaint precludes the contestation of any non-performance and entails the forfeiture of the right to request compensation for damages for the disservice complained of.

  1. SALES CONTRACT

Villago srl assumes responsibility towards the customer/beneficiary for the good execution of the contractual obligations, also answering for the services paid by its suppliers.

In this case, Villago srl has the right to take action against those directly responsible.

However, Villago srl is exempt from any liability in the event that it demonstrates that the failed or bad execution of the service is attributable to the purchaser or the beneficiary and/or to unforeseeable events, caused by third parties or by force majeure.

  1. INSURANCE

Villago srl has an insurance policy stipulated with Europ Assistance for the civil liability of travel organizers. The policy is mandatory.

All participants in the Villago V-BOX are covered by an insurance policy. All the conditions of the insurance coverage envisaged and the relative limitations are indicated in article 21 of the section “TERMS AND CONDITIONS FOR WEEKENDS AND TRAVELS” of this document, which are reproduced here in full and also apply to the case of V-BOXES.

It is the responsibility and responsibility of the customer/beneficiary of the service to read the insurance coverage foreseen and/or available also for the suppliers of tourist services.

 

 

  1. D) TERMS AND CONDITIONS APPLICABLE TO THE SALE OF FOOD AND WINE PRODUCTS AND BEAUTY, CULTURAL AND STYLE PRODUCTS IN THE “SHOP” SECTION OF THE VILLAGO.IT WEBSITE

Premise

Purchases made through the site www.villago.it , in the SHOP section, and the related contracts are governed by these general conditions of sale or by the specific different conditions indicated from time to time on the site on the date of conclusion of the contract and in any case from the provisions of section II of Legislative Decree no. 206 of 6 September 2005, (so-called consumer code) regarding the protection of consumers in respect of distance contracts.

  1. GENERAL PROVISIONS and DEFINITIONS

These general conditions of sale are valid between the company Villago srl and the natural person who makes online purchases through the website www.villago.it in the SHOP section, specifically in the sections “Food and wine products for your every special moment” and products of beauty, culture and style inspired by historic residences”.

The purchase of products is permitted only to natural persons of legal age who have read and accepted the information relating to the processing of personal data, have accepted these general conditions of sale and who operate without resale purposes.

The customer declares to be informed of the regulations in force concerning the consumption of alcoholic substances.

To better understand the products sold and how to present them on the website www.villago.it , consider the following definitions:

  • The food and wine products: This section contains the food products made in the farms of the historic Italian residences with which Villago srl operates or related to them. In this section, alongside the food and wine products, also offered in combination with each other, videos produced and created by Villago srl relating to the tasting of the products themselves are also sold.

The food and wine products are presented on the Villago srl website divided according to the moments in which they are used.

  • Products of beauty, culture and style: This section contains the following products:
  1. a) products relating to beauty and body care, made in historic Italian residences or related to them;
  2. b) books relating to historic Italian residences with which Villago srl operates or connected to them. Together with the books, Villago srl also sells tickets to take part in guided tours, walks or trips that concern the historic residences covered by the books themselves.
  3. c) style products such as gadgets and clothing made and produced by Villago srl;
  4. OBJECT OF THE CONTRACT

With these general conditions of sale, Villago srl remotely sells to the customer the products offered on the website www.villago.it in the sections indicated in the previous article.

The purchase contract is concluded via the internet, by accessing the user at www.villago.it and the subsequent completion of the purchase order according to the procedure illustrated in the following article 4

The customer undertakes to read, before proceeding with the confirmation of his order, these general conditions of sale, with specific reference to the pre-contractual information reserved for the consumer and highlighted in the following article 3 and the Right of Withdrawal highlighted in the following point 10

  1. PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER

Before concluding the purchase contract, the user must examine the characteristics of the goods illustrated by the data sheet of the product he intends to purchase.

Before proceeding with the validation of the order with obligation to pay, the user can view the order summary containing the following information: a) total price of the goods, including taxes, with specific indication of shipping costs as well as any other cost charged to the user; b) method of payment.

To proceed with the purchase it is necessary to accept the Contract. If the user does not accept the Agreement he will not be able to use the Service.

  1. PURCHASE PROCEDURE

  1. b) After the selection phase, the customer will send the order, this constitutes an offer for the purchase of the products covered by the order.
  2. c) Once the order has been transmitted, the buyer receives confirmation of receipt of the purchase order at the e-mail address indicated. The order confirmation contains the user’s data, the order number, the price of the products purchased, an indication of the shipping costs, an indication of the delivery address. The purchase contract will be considered concluded with the sending of the order confirmation to the user.

  1. EXECUTION OF ORDERS

The execution of the order is carried out by Villago srl in compliance with the terms indicated on the summary page of the order confirmation communication and is subject to the successful completion of the payment of the amount, the shipping costs and all the payment items indicated .

Order fulfillment is subject to the discretionary acceptance of the same by Villago srl and to the availability of the products ordered

The online indication of the availability of the product selected for purchase must be considered purely indicative since: a) the products could be sold to other users before receiving the order confirmation e-mail, due to the simultaneous online presence of multiple users; b) computer anomalies could occur such as to make products available for purchase that are not actually available c) the artisan production chains could be dependent on the seasonality of the product, or on climatic situations that can condition production or transport and do not guarantee guarantee the best maintenance of the products and their flavors .

In the event of the unavailability of the products ordered, the order will be automatically corrected by deleting the unavailable products.

The user will be informed of the total or partial unavailability of the products; the latter will have the right to confirm the order in relation to the products actually available or to completely revoke the purchase order.

  1. PRICES

The sales prices of the products indicated on the website www.villago.it are expressed in euros and include value added tax. Shipping costs are not included in the purchase price; these costs are highlighted at the time of conclusion of the purchase process, before the user makes the payment, and are intended exclusively for shipments to Italy.

  1. TERMS OF PAYMENT

The user can pay the amount resulting from the purchase order using the following payment methods:

Credit card Visa, Mastercard, American Express, Postepay, Paypal

In cases of non-executed orders, the supplier guarantees to cancel the authorized transaction and the credit received.

  1. DELIVERY

Deliveries are made to the address indicated by the user, according to the methods and in compliance with the times specified in the order confirmation.

Upon delivery, the user must verify that the number of packages indicated on the invoice or waybill is the one actually delivered and that the package is intact and undamaged, specifying any anomalies found by noting them on the delivery form. Any disputes due to discrepancies must be reported to the courier by indicating on the waybill, which the Customer will sign, the following sentence: “Withdrawn subject to control”, otherwise the package will be considered delivered correctly. These disputes and possibly those relating to the contents of the package must then be confirmed within 2 days of delivery to customer service or by email at [email protected]. Deliveries are made by courier throughout the national territory.

As regards the videos produced by Villago srl and relating to the tastings of food and wine products resold by Villago srl and associated with them, they will be delivered exclusively via email to the address that the user will provide at the time of purchase.

As regards tickets for participation in guided tours linked to the purchase of books, these will be delivered in a sealed envelope in the package containing the purchased books. The user can also request tickets online via e-mail, to the e-mail address that he will provide at the time of purchase.

Villago srl is not responsible: for errors in delivery due to inaccuracies or incompleteness in completing the purchase order by the user, nor for any damage that may occur to the products after delivery of the products to the carrier, nor for delays in delivery which are attributable to the carrier.

Villago srl is not liable for any delays in delivery or for the non-delivery of the products purchased in the event that the delay or non-delivery depends on unforeseeable exceptional circumstances

Variable Weight of Products: Seasoned or cooked products have variable weight and in some cases may suffer a slight weight loss. The indicated weight is the average weight with respect to which there may be a deviation up or down of 10%.

  1. AFTER SALES ASSISTANCE

In the event of found lack of conformity of the product purchased, the buyer must promptly send the complaint of the defect of the product found to the e-mail address [email protected], expressly indicating: the description of the defect found; the product code; the progressive order number issued at the time of purchase; the identification details of the invoice issued by the seller in relation to the products purchased.

  1. RIGHT OF WITHDRAWAL

The buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the products. This right does not apply to products delivered sealed which have been opened by the purchaser. Pursuant to and by effect of art. 55, second paragraph, letter C, of ​​the Consumer Code, the Customer cannot exercise the right of withdrawal for products represented by foodstuffs which, by their nature, cannot be returned or which are liable to deteriorate or expire rapidly.

The notice of withdrawal must be sent by e-mail to the pec address [email protected] within the term of 14 (fourteen) days starting from the date of delivery and must contain: a) the expression of will by the user of exercise the right of withdrawal pursuant to and for the purposes of art. 54 of Legislative Decree no. 21/2014; b) the indication of the products for which the purchaser intends to exercise the right of withdrawal, including the specification of the article code of the product; c) the progressive order number issued at the time of purchase; d) the identification details of the invoice issued by the seller in relation to the products purchased.

The costs of returning the goods are borne by the buyer. The products to be returned must be sent to the following address: Villago srl, via Segantini 11, 22046 Merone (CO).

The goods must be returned intact, in their original packaging, complete in all their parts, accompanied by the attached tax documentation. The buyer is responsible for the packaging of the goods which he intends to return.

Without prejudice to the right to verify the integrity of the products and compliance with the above, Villago srl will reimburse the entire cost of the product paid by the user, using the same means of payment used at the time of purchase, within the term maximum of thirty days from the date of receipt of the returned goods.

  1. LIMITATIONS OF THE RIGHT OF WITHDRAWAL

Returned products that are damaged or used in a different and further way than what is strictly necessary to establish their nature, characteristics and functioning will be reimbursed after deduction of the decrease in value resulting from the damage or use. Reimbursement is excluded when the decrease in value is total.

The User is requested to insert a copy of the delivery document received inside the package.

The right of withdrawal is in any case excluded in relation to:

goods made to measure or clearly personalized;

the supply of goods which are liable to deteriorate or expire rapidly;

the supply of sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery.

The supply of videos for tastings associated with the products to be tasted, if the videos have been downloaded and/or seen following their transmission by Villago srl

If one of the aforementioned exceptions were applicable to the goods purchased by the User, the latter will not be able to exercise the right of withdrawal.

  1. APPLICABILITY OF THE WITHDRAWAL CLAUSES

The clauses concerning the exercise of the right of withdrawal, as well as the relative consequences and exceptions, apply exclusively to the User who qualifies as a consumer, i.e. to the User who acts for purposes unrelated to his business and professional activity.

  1. PURCHASER’S RESPONSIBILITY

The buyer must guarantee:

  1. a) to be of age;
  2. b) to have provided truthful, complete and updated data;
  3. c) to communicate any changes to their data.
  4. d) to use the purchase system correctly and to fill in all the sections/forms required to proceed with the purchase of the products contained on the Villago srl website in the aforementioned sections.
  5. WARRANTY

The User who purchases as a consumer has the right to guarantee the conformity of the products and services purchased within the limits of 24 months from the purchase, provided that notice is given within 2 months of their discovery.

To exercise the right of guarantee, the User must contact Villago srl, via pec at the following address [email protected] giving an accurate description of the defect found.

If the lack of conformity of the product is ascertained, the User has the right to obtain, at his choice, the repair or replacement of the product.

The User also has the right to ask the Owner for a reasonable price reduction or termination of the contract in the following cases:

  1. a) if the repair and replacement prove impossible or excessively expensive;
  2. b) if the Owner has not repaired or replaced the goods within a reasonable period, in any case not less than 15 days;
  3. c) if the replacement or repair previously carried out has caused significant inconvenience to the User.
  4. d) The User is still required to return the defective products.
  5. INDEMNITY

The User undertakes to indemnify the owner (as well as any company controlled or affiliated by the same, its representatives, directors, agents, licensees, partners and employees), from any obligation or liability, including any legal fees incurred to defend themselves in court, which may arise in the event of damages caused to other Users or third parties, in relation to the contents uploaded online, to the violation of the law or the terms of these conditions of service.

  1. LIMITATION OF LIABILITY

All the features accessible through the Villago srl website are made available to Users, under the terms and conditions set out in the Contract, without any guarantee, explicit or implicit, that is not required by law. In particular, no guarantee is given as to the suitability of the services offered for the particular purposes set by the User.

The use of the Villago srl site and of the functions accessible through it is carried out by Users at their own risk and under their own responsibility.

In particular, Villago srl, within the limits of the applicable law, is liable for damages of a contractual and non-contractual nature towards Users and third parties exclusively by way of willful misconduct or gross negligence when these constitute an immediate and direct consequence of the activity of Villago srl. Therefore, Villago srl will not be responsible for:

  1. a) any losses that are not a direct consequence of the breach of the Contract by Villago srl;
  2. b) any loss of commercial opportunity and any other loss, even indirect, possibly suffered by the User (such as, by way of example and not limited to, commercial losses, loss of revenues, income, profits or presumed savings, loss of contracts or relationships business, loss of reputation or goodwill, etc.);
  3. c) damages or losses deriving from interruptions or malfunctions of the Villago srl website due to force majeure events or, in any case, to unforeseen and unforeseeable events and, in any case, independent of the will and unrelated to the Controller’s sphere of control such as, by way of example and not exhaustive, failures or interruptions to telephone or electricity lines, to the Internet and/or in any case to other transmission tools, unavailability of websites, strikes, natural events, viruses and IT attacks, interruptions in the supply of products, services or third party applications; and incorrect or unsuitable use of Tannico by Users or third parties.
  4. SERVICE INTERRUPTION

To guarantee Users the best possible use of the Service, the Owner, Villago srl, reserves the right to interrupt the Service due to the need for maintenance or system updating, informing Users through constant updates of the website www.villago.it.

  1. RESALE OF THE SERVICE

Users are not authorized to reproduce, duplicate, copy, sell, resell or exploit any portion of the Villago srl shop, on the website www.villago.it, and its Services without the Owner’s prior written permission, granted directly or through a specific reseller program.

The Owner could tolerate forms of resale carried out on a personal (one to one) and limited basis; any form of mass resale is expressly excluded.

  1. PRIVACY POLICY

For information on the use of personal data, Users must refer to the privacy policy of Villago srl, which is considered part of these Terms.

  1. INTELLECTUAL PROPERTY RIGHTS

All trademarks of Villago srl, figurative or nominative, and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos that appear concerning Villago srl are and remain the exclusive property of the Owner or its licensors and are protected by applicable trademark laws and related international treaties.

All trademarks and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos relating to third parties and the contents of third parties published on the Villago srl website are and remain the exclusive property or availability of such third parties and their licensors and are protected by applicable trademark laws and related international treaties. The Data Controller does not own these intellectual property rights and can only use them within the limits and in accordance with the contracts entered into with such third parties and for the purposes outlined therein.

  1. AGE LIMITS

The User who purchases the products in the Villago shop on the website www.villago.it must be of legal age and declares to have reached the age of majority.

Furthermore, the User who makes the purchase through Villago srl declares and guarantees that whoever receives the shipment of the purchased products is of age according to the legislation applicable to the latter.

  1. CHANGES TO THESE TERMS

The Owner, Villago srl, reserves the right to make changes to the Terms at any time, giving notice to the User by publishing it on the website www.villago.it

The User who continues to use the website www.villago.it after the publication of the changes accepts the new Terms without reserve.

  1. ASSIGNMENT OF THE CONTRACT

The Owner reserves the right to transfer, assign, dispose by novation or subcontract all or some of the rights or obligations deriving from the Terms, provided that the User’s rights provided herein are not affected.

The User may not assign or transfer in any way his rights or obligations under the Terms without the written authorization of the Owner.

  1. INEFFECTIVENESS AND PARTIAL NULLITY

If any clause of the Terms should be null, invalid or ineffective, the aforementioned clause will be eliminated while the remaining clauses will not be affected by this and will remain fully effective.

  1. APPLICABLE LAW AND JURISDICTION

These Terms and all disputes regarding the execution, interpretation and validity of this contract are subject to the law, to the jurisdiction of the State and to the exclusive jurisdiction of the court of the place where Villago srl has its registered office.

The exclusive forum of the consumer is an exception, if the law so provides.
